The Working Group encourages the Government to take steps to clarify outstanding cases, and reminds the Government of its obligations under the Declaration to prevent and to terminate all acts of enforced disappearance and to prosecute alleged perpetrators.

255. The Working Group would like to remind the Government of its obligations under article 16 of the Declaration that persons " shall be tried only by the competent ordinary courts in each State, and not by any other special tribunal, in particular military courts " .

425. The Working Group reminds the Government of its obligations under article 13, paragraph 3, of the Declaration to take steps to ensure that all persons involved in the investigation of an enforced disappearance, including the complainant, counsel, witnesses and those conducting the investigation, are protected against ill-treatment, intimidation or reprisal.
425- يذكّر الفريق العامل الحكومة بالتزاماتها بموجب الفقرة 3 من المادة 13من الإعلان بأن تتخذ خطوات تكفل لجميع المشاركين في التحقيق في حالة من حالات الاختفاء القسري، بمن فيهم صاحب الشكوى والمحامي والشهود ومن يقومون بالتحقيق، الحماية من سوء المعاملة أو التهديد أو الانتقام.

The Chairman said that the Bureau had borne in mind that the fourth periodic report of the Russian Federation was due on 4 November 1993 and accordingly proposed that a note verbale should only be sent if the report was not submitted on time, and that, in the meantime, a letter should be sent to remind the Government of its obligations under article 40 of the Covenant.

315. The Working Group reiterates to the Government its obligation under the Declaration to prevent and to terminate all acts of enforced disappearance.

Although the implementation of the strategy will contribute towards the realization of the Government's obligations under international human rights law, the interim strategy would benefit by explicitly identifying international human rights obligations as an applicable legal framework.

The Working Group reminds the Government of its obligations under the Declaration that " any person deprived of liberty shall be held in an officially recognized place of detention and, in conformity with national law, be brought before a judicial authority promptly after detention " (art.10).
267- يذكر الفريق العامل الحكومة بالتزاماتها بموجب الإعلان بأن " يحتجز أي شخص، محروم من حريته، في مكان احتجاز معترف به رسمياً وأن يعرض، وفقاً للقانون الوطني، على سلطة قضائية فور احتجازه " (المادة 10).

The Working Group notes with concern the increase in the number of contemporary cases of enforced disappearances in Pakistan and reminds the Government of its obligations under the Declaration to prevent and terminate acts of enforced disappearance in any territory under its jurisdiction (art. 3).
388- يلاحظ الفريق العامل بقلق التزايد في عدد حالات الاختفاء القسري الجديدة في باكستان، ويذكر الحكومة بالتزاماتها بموجب الإعلان بمنع وإنهاء أعمال الاختفاء القسري في أي إقليم خاضع لولايتها (المادة 3).

195. The Working Group notes with concern the increase in the number of contemporary cases of enforced disappearances in Egypt and reminds the Government of its obligations under the Declaration to prevent and terminate acts of enforced disappearances in any territory under its jurisdiction (art. 3).
195- يلاحظ الفريق العامل بقلق تزايد عدد الحالات الجديدة للاختفاء القسري في مصر، ويذكر الحكومة بالتزاماتها بموجب الإعلان لمنع وإنهاء أعمال الاختفاء القسري على جميع الأراضي التي تخضع لاختصاصها (المادة 3).

254. The Working Group also reminds the Government of its obligations under article 16, paragraph 1, of the Declaration stating that " persons alleged to have committed any acts referred to in article 4, paragraph 1, shall be suspended from any official duties during the investigation " .
254- كما يذكّر الفريق العامل الحكومة بالتزاماتها بموجب الفقرة 1 من المادة 16 من الإعلان التي تنص على أن " يجري إيقاف الأشخاص المدعى ارتكابهم أياً من الأعمال المشار إليها في الفقرة 1 من المادة 14 أعلاه، عن أداء أي واجبات رسمية أثناء التحقيق " .

349. The Group wishes to remind the Government of its obligations under article 10 of the Declaration to hold persons deprived of liberty only in officially recognized places of detention, to bring them promptly before a judicial authority and to make accurate information on the detention of such persons promptly available to their family members, their legal counsel, or to any other persons having a particular interest.

Special procedures have issued urgent appeals on these cases, reminding the Government of its obligations under international standards to respect the prisoners' right to health and to ensure humane treatment, which requires the transfer of sick prisoners who need specialist medical care to specialized institutions or civilian hospitals.
وقد أصدر المكلفون بولايات في إطار الإجراءات الخاصة نداءات عاجلة بشأن هاتين الحالتين، وذكّروا الحكومة بالتزاماتها بموجب المعايير الدولية باحترام حق السجناء في التمتع بالصحة وكفالة المعاملة الإنسانية، مما يتطلب نقل السجناء المرضى إلى مؤسسات متخصصة أو مستشفيات مدنية عندما يحتاجون إلى عناية طبية متخصصة().

402. The Working Group reminds the Government of its obligations under article 13.3 of the Declaration, to prevent ill-treatment, intimidation or reprisal against those involved in the investigation, and article 13.5, to take steps " to ensure that any ill treatment, intimidation, reprisal or any other form of interference on the occasion of the lodging of a complaint or during the investigation procedure is appropriately punished " .
402- يُذكِّر الفريق العامل الحكومة بالتزاماتها بموجب الفقرة 3 من المادة 13 من الإعلان بمنع سوء المعاملة أو التهديد أو الانتقام في حق المشاركين في التحقيق، والفقرة 5 المادة 13 باتخاذ تدابير " لضمان المعاقبة بالعقوبات المناسبة على أي معاملة سيئة أو تهديد أو عمل انتقامي أو أي شكل من أشكال التدخل، تقع لدى تقديم الشكوى أو أثناء إجراء التحقيق " .

89. The Working Group reminds the Government of its obligations under the Declaration to conduct thorough and impartial investigations " for as long as the fate of the victim of enforced disappearance remains unclarified " (art. 13.6) and to ensure that statutes of limitations, where they exist, relating to acts of enforced disappearance are substantial and commensurate with the extreme seriousness of the offence (art. 17.3).
89- يذكِّر الفريق العامل الحكومة بالتزاماتها بموجب الإعلان بإجراء تحقيقات شاملة ونزيهة " ما دام مصير ضحية الاختفاء القسري لم يتضح بعد " (الفقرة 6 من المادة 13) وبأنه إذا كان ثمة مجال للتقادم، فيجب أن يكون التقادم المتعلق بأعمال الاختفاء القسري طويل الأجل وبما يتناسب مع الجسامة الشديدة لهذه الجريمة (الفقرة 3 من المادة 17).

502. The Working Group reminds the Government of its obligations under the Declaration, mainly that all acts of enforced disappearances shall be offences under criminal law punishable by appropriate penalties which shall take into account their extreme seriousness (art. 4.1), and that all acts of enforced disappearances shall be investigated for as long as the fate of the victim of enforced disappearance remains unclarified (art. 13.6).
502- يُذكِّر الفريق العامل الحكومة بالتزاماتها بموجب الإعلان باعتبار أن كل عمل من أعمال الاختفاء القسري جريمة يعاقب عليها بالعقوبات المناسبة التي تراعى فيها شدة جسامتها في نظر القانون الجنائي (المادة 4-1)، وأنه يجب إجراء تحقيق في كل عمل من أعمال الاختفاء القسري ما دام مصير ضحية الاختفاء القسري لم يتضح بعد (المادة 13-6).

514. The Working Group reiterates to the Government its obligation under the Declaration to prevent and to terminate all acts of enforced disappearance.

9. While disarmament on any scale may be seen as progress towards the fulfilment of the Government's obligations under Security Council resolution 1556 (2004), such efforts are unlikely to reduce levels of insecurity or restore confidence unless they are conducted according to a systematic methodology and subject to independent verification.
