The Iraqi Special Tribunal has been the subject of analysis and special concern for the Special Rapporteur, who reiterates his reservations regarding its legitimacy, the restriction placed on its jurisdiction in terms of people and time, and the breach of international human rights principles and standards to which it gives rise.

51. The Special Rapporteur points out that the Iraqi Special Tribunal has certain deficiencies and that its legitimacy has been rightfully criticized, with the result that its credibility has been called into question.

Most importantly, article 27 (2) of the Iraqi Special Court's Statute provides that sentences shall be enforced within 30 days of becoming final, which in the case of imposition of the death penalty could result ina precipitous and irremediable end to the proceedings.
وأهم من ذلك، تنص المادة 27(2) من النظام الأساسي للمحكمة الخاصة العراقية على أن العقوبات تنفذ في غضون 30 يوماً بعدما تصبح نهائية، الأمر الذي يمكن في حالة الحكم بعقوبة الإعدام أن يؤدي إلى نهاية متسرعة ولا رجعة فيها للإجراءات.

45. The current state of affairs is exacerbated by allegations surrounding the actions of Iraqi Special forces, under the command of the Ministry of Interior, and armed militias accused of engaging in human rights violations, including execution style killings and torture.
45 - ومما يؤدي إلى تفاقم الحالة الراهنة، المزاعم التي تتردد حول تصرفات القوات الخاصة العراقية الخاضعة لإمرة وزارة الداخلية والميليشيات المسلحة المتهمة بالضلوع في انتهاكات لحقوق الإنسان من بينها عمليات القتل المنفذة بأسلوب الإعدام، والتعذيب.

(h) The Interim Iraqi Government may wish to undertake a review of the Statute of the Iraq Special Tribunal so as to ensure that the criminal justice process complies with international fair trial standards, that recent developments in international criminal law are taken into account and that the application of the death penalty remains suspended;
(ح) قد ترغب الحكومة العراقية في مراجعة النظام الأساسي للمحكمة الخاصة العراقية حرصاً منها على أن تمتثل الإجراءات القضائية الجنائية للمعايير الدولية للمحاكمة العادلة، وأن تؤخذ في الاعتبار التطورات التي طرأت مؤخراً في القانون الجنائي الدولي، وأن يبقى وقف العمل بعقوبة الإعدام سارياً؛

For purposes of review of claims for receivables owed by an Iraqi party, such claims include claims for debts and obligations owed both by the Iraqi government and Iraqi private parties operating or residing in Iraq.
