15. The Special Rapporteur notes that one of the principal obstacles to detailed analysis and more effective protection of the rights of migrant domestic workers is the difficulty of quantifying the phenomenon.

16. According to the information received by the Special Rapporteur, migrant domestic workers are vulnerable to abuses and violations of their rights.
16- ووفقاً للمعلومات التي تلقتها المقررة، فإن الخدم المنزليين المهاجرين هم شديدو التعرض للتجاوزات ولانتهاك حقوقهم(6).

24. Some ILO Conventions deal with specific issues very relevant to the situation of migrant domestic workers.
24- وبعض اتفاقيات منظمة العمل الدولية(8) تتناول مسائل محددة ذات صلة خاصة بحالة الخدم المنزليين المهاجرين.

In others cases, so as to protect the rights of their nationals, governments such as that of the Philippines have negotiated and signed bilateral agreements or memoranda of understanding with countries of destination, and have established mechanisms and programmes to ensure that migrant domestic workers migrate in proper conditions and are aware of their rights and of complaint and protection mechanisms.
وفي حالات أخرى، عمدت بعض الحكومات، كحكومة الفلبين، حرصاً منها على حماية حقوق رعاياها، إلى التفاوض بشأن توقيع اتفاقات ثنائية ومذكرات تفاهم مع بلدان الوجهة، ووضعت آليات وبرامج لضمان هجرة الخدم المنزليين المهاجرين في ظل أوضاع نظامية ولتوعيتهم بحقوقهم وبآليات التظلم والحماية المتاحة لهم.

It would also enable the consulates of the countries of origin, besides the relevant services in the country of destination, private recruitment agencies and NGOs, to monitor migrant domestic workers' working conditions and to offer protection when necessary.
ومن شأن ذلك أيضاً أن يتيح لقنصليات بلدان المنشإ ، وكذلك للدوائر المختصة في بلد المقصد وللوكالات الخاصة التي تتولى استجلاب الخدم المنزليين، وللمنظمات غير الحكومية، أن ترصد أوضاع عمل الخدم المنزليين المهاجرين وتقدم لهم الحماية عند الضرورة.

78. The Special Rapporteur recommends that the legislation and policies of countries of origin and of destination should provide for mechanisms to monitor the work of recruitment agencies, with a view to ensuring that they respect the rights and interests of migrant domestic workers.
78- وتوصي المقررة الخاصة بتضمين تشريعات وسياسات بلدان المنشإ وبلدان المقصد آليات رقابة على أعمال الوكالات التي تتولى استجلاب الخدم المنزليين المهاجرين للتحقق من مراعاتها لحقوقهم ومصالحهم.

83. The Special Rapporteur recommends that legislation in the countries of destination should not allow migrant domestic workers to be dismissed in the event of illness without fair compensation.
83- وتوصي المقررة الخاصة بلدان المقصد بألا تتيح في تشريعاتها إمكانية فصل الخدم المنزليين المهاجرين في حال مرضهم دون منحهم تعويضاً منصفاً.

In some wealthy countries the demand for migrant domestic workers has grown considerably in recent years, in proportion to economic development.
وفي بعض البلدان الثرية، ازداد الطلب على الخدم المنزليين المهاجرين زيادة كبيرة في السنوات الأخيرة وبدرجة متناسبة مع التنمية الاقتصادية(3).

It can accordingly be asserted that migrant domestic workers enjoy these rights irrespective of their migratory situation.
وعليه، يمكن القول إن الخدم المنزليين المهاجرين يتمتعون بهذه الحقوق بصرف النظر عما إذا كان وضعهم نظامياً أم غير نظامي بنظر سلطات الهجرة(7).

23. Although to date the International Convention on the Protection of the Rights of All Migrant Workers and Members of Their Families has been ratified by only 24 States, the Special Rapporteur considers that it is important for the situation of migrant domestic workers because it incorporates a minimum standard of rights for all migrant workers and their families.
23- وعلى الرغم من أن الاتفاقية الدولية لحماية حقوق جميع العمال المهاجرين وأفراد أسرهم لم تصدِّق عليها سوى 24 دولة حتى هذا التاريخ، ترى المقررة الخاصة أن هذه الاتفاقية هي ذات أهمية فيما يتعلق بحالة الخدم المنزليين المهاجرين لأنها تتضمن معياراً أدنى للحقوق لجميع العمال المهاجرين وأفراد أسرهم.
