31. Mr. Mitrović (Serbia and Montenegro) said that the words " the law requires " clearly referred to cases where the law of a particular country required a communication or contract to be in writing.
31- السيد ميتروفيتش (صربيا والجبل الأسود): قال إن من الواضح أن عبارة " يشترط القانون " تشير إلى الحالات التي يشترط فيها قانون بلد معين أن يكون الخطاب أو العقد خطيا.

As such a determination could only be made ex post by a court or other trier of fact, the parties to the electronic communication or contract would not be able to know with certainty in advance whether the electronic signature used would be upheld by a court or other trier of fact as " appropriately reliable " or whether it would be denied legal validity for not having met such requirement.
