2.1 Abdelhamid Al Daquel is a former Libyan Air Force pilot, born on 22 March 1963 in Beni Walid.

As a victim of enforced disappearance, Abdelhamid Al Daquel was de facto prevented from exercising his right of recourse to challenge the lawfulness of his detention, in violation of article 2, paragraph 3, of the Covenant.
وباعتباره ضحية للاختفاء القسري، منع عبد الحميد الداقل بحكم الأمر الواقع من ممارسة حقه في الطعن في شرعية احتجازه، وذلك في انتهاك للفقرة 3 من المادة 2 من العهد.

His death, which occurred in unknown circumstances that continue to be concealed by the State party, constitutes a violation by the State party of article 6, paragraph 1, of the Covenant in respect of Abdelhamid Al Daquel.

Moreover, given that Abdelhamid Al Daquel died during his prolonged incommunicado detention, when he was at all times in the hands of the State party, and in circumstances that have yet to be explained, the Committee can only find that the State party has violated Abdelhamid Al Daquel's right to life under article 6, paragraph 1, of the Covenant.

Abdelhamid Al Daquel was not brought before a judicial authority, which would have enabled him to challenge the lawfulness of his detention, and no official information was given to his family regarding his place of detention or his fate.
ولم يمثل عبد الحميد الداقل أمام سلطة قضائية كان يمكنه الطعن أمامها في شرعية احتجازه، ولم تُعطَ أسرته أية معلومة رسمية عن مكان احتجازه أو مصيره.

The Committee is of the view that, in the circumstances, Abdelhamid Al Daquel's right to recognition as a person before the law was violated as a result of his intentional removal from the protection of the law, in breach of article 16 of the Covenant.
وفي هذه الظروف، ترى اللجنة أن حق عبد الحميد الداقل في الاعتراف له بشخصيته القانونية قد انتهك بسبب حرمانه عمداً من الحماية التي يوفرها القانون، مما يشكل انتهاكاً للمادة 16 من العهد.

وقد فرغت من النظر في البلاغ رقم 1882/2009، الذي قدمه الجيلاني محمد محمد الداقل بموجب البروتوكول الاختياري الملحق بالعهد الدولي الخاص بالحقوق المدنية والسياسية،

The Committee notes that the case of Abdelhamid Al Daquel was reported to the Working Group on Enforced or Involuntary Disappearances, the Special Rapporteur on extrajudicial, summary or arbitrary executions and the Special Rapporteur on the question of torture.
وتلاحظ اللجنة أن قضية عبد الحميد الداقل قد عُرضت على الفريق العامل المعني بحالات الاختفاء القسري أو غير الطوعي والمقرر الخاص المعني بحالات الإعدام خارج القضاء أو بإجراءات موجزة أو تعسفاً والمقرر الخاص المعني بمسألة التعذيب.

3.1 The author claims that Abdelhamid Al Daquel was subjected to enforced disappearance after his arrest on 26 January 1989 by officials of the Libyan State Internal Security Agency, since his arrest was followed by a refusal to acknowledge his deprivation of liberty or to reveal what had happened to him.
3-1 يؤكد صاحب البلاغ أن عبد الحميد الداقل تعرّض للاختفاء القسري على أثر اعتقاله يوم 26 كانون الثاني/يناير 1989، من قبل عناصر من الأمن الداخلي الليبي، وتلا اعتقاله رفض الاعتراف بسلبه حريته والتكتم على المصير الذي لاقاه.

3.5 Under article 9, the author recalls that Abdelhamid Al Daquel was arrested by the State security services without a warrant and without being told of the reasons for his arrest, in violation of article 9, paragraph 1, of the Covenant.
3-5 وفيما يتعلق بالمادة 9 من العهد، يذكّر صاحب البلاغ في المقام الأول بأن عبد الحميد الداقل اعتُقل على يد أجهزة الأمن الداخلي دون أمر قضائي ودون أن يُطلَع على أسباب اعتقاله، وفي ذلك انتهاك للفقرة 1 من المادة 9 من العهد.

6.2 The Committee takes note of the statement by the author, which has not been contested, to the effect that Abdelhamid Al Daquel was arrested in Foum Molghat on 26 January 1989 by officials of the internal security forces and taken to an unknown destination together with three other individuals who were apprehended at the same time.
6-2 وتحيط اللجنة علماً بادعاء صاحب البلاغ، الذي لم تنفيه الدولة الطرف، أن عبد الحميد الداقل أوقف في 26 كانون الثاني/يناير 1989 في فم ملغاة من قبل عناصر من جهاز الأمن الداخلي، واقتيد إلى وجهة مجهولة بحضور ثلاثة أشخاص آخرين أوقفوا في نفس الوقت.

In the absence of any satisfactory explanation by the State party, the Committee finds a violation of article 7 of the Covenant in respect of Abdelhamid Al Daquel.
