The resolution recommends that persons habitually resident in the successor territory should be presumed to acquire the nationality of the successor State.

This provision contradicts other provisions in the draft articles which stipulate that, in relation to the succession of States, the person concerned has the nationality of the successor State.

A fortiori, such a successor State may not call into question an express acceptance formulated by the predecessor State.

In the absence of any such clarification, a successor State shall be considered as maintaining the interpretative declarations of the predecessor State.
