7.16 If the Committee were to consider that the second and third sentences of article 14, paragraph 1, are applicable to the author's case, then the State party notes that:

As to the current detention, while he has sought interim release, at no time has he directly challenged the lawfulness of his detention. As to the current detention, the State party notes that the author has on several occasions unsuccessfully sought release from the Minister and the Federal Court.

4.14 As to the observations on the Jouni Länsman case submitted by the Forestry Service after the expiry of the appeal time limit, the State party notes that this occurred simply because the Committee's Views were delivered after that point.

The State party notes, however, that this petition refers to the general situation of the Tutsi in the Democratic Republic of the Congo and therefore does not concern the complainant and his children, especially since, in the course of the asylum proceedings, the Swiss authorities had called their Tutsi origins into question.

6.9 As to the author's allegation that the filing of an application for asylum is in itself a relevant ground within the meaning of article 3, paragraph 1, of the Convention, the State party observes that the author adduces no evidence in support of this argument.
٦-٩ وبالنسبة لزعم مقدم البلاغ أن تقديم طلب اللجوء يشكل بحد ذاته أساسا وجيها بمفهوم الفقرة ١ من المادة ٣ من الاتفاقية، فإن الدولة الطرف تلاحظ أن مقدم البلاغ لم يشفع بلاغه بأي دليل دعما لهذه الحجة.

10.3 Finally, the State party observes that it is " in a difficult position attempting to defend the criminal justice system of the United States before the Committee.
٠١-٣ وأخيرا، فإن الدولة الطرف تلاحظ أنها: " توجد في وضع صعب عند محاولتها الدفاع أمام اللجنة عن نظام القضاء الجنائي للولايات المتحدة.

While the authors are currently serving sentences, the State party observes that they have not yet served the period that they would have had to serve had they been sentenced to a finite sentence.
وفي حين أن أصحاب البلاغ يقضون فترات سجنهم حالياً، فإن الدولة الطرف تلاحظ أنهم لم يقضوا بعد فترات السجن التي كانوا سيقضونها لو حُكم عليهم بالسجن لمدة محددة(11).
