An objection by a contracting State or by a contracting organization to a reservation does not preclude the entry into force of the treaty as between the objecting State or international organization and the reserving State or organization.

In such a situation, the right of a contracting State or contracting international organization to formulate an objection up until the expiry of that period should be recognized.

A reservation formulated by a State or an international organization is established with regard to a contracting State or a contracting organization if it is permissible and was formulated in accordance with the required form and procedures, and if that contracting State or contracting organization has accepted it.

An objection by a contracting State or by a contracting international organization to a valid reservation does not preclude the entry into force of the treaty as between the objecting State or international organization and the reserving State or organization, unless a contrary intention has been definitely expressed by the objecting State or organization [in accordance with guideline 2.6.8].

Article 20, paragraph 4 (b), of the 1986 Convention refers to " an objection by a contracting State or by a contracting organization to a reservation ... " .

Accordingly, the guideline excludes, in principle, the capacity of a contracting State or State party to a treaty to object, in respect of a successor State, to a reservation to which it had not objected in respect of the predecessor State.

118. Another case that should be considered is that of a party or contracting State to a treaty that has not objected in time to a reservation formulated by a predecessor State and considered as being maintained by the successor State after the succession of States.
118 - ويجدر أيضا بالنظر حالة الدولة المتعاقدة أو الطرف في المعاهدة، التي لم تكن قد اعترضت في الوقت المناسب على التحفظ الذي أبدته الدولة السلف، والذي يُعدّ تحفظا استبقته الدولة الخلف نتيجة لخلافة الدول.
