The Court recognized the right of the Contracting State to establish a rule, in accordance with the longstanding and generally accepted tradition of using two different forms of the same name in Russian and Ukrainian, which rule applied in the absence of any clearly expressed wish of the person concerned to the contrary.
واعترفت المحكمة بحق الدولة المتعاقدة في وضع قاعدة وفقاً للتقليد المعمول به منذ وقت طويل وبشكل عام والمتمثل في استخدام شكلين مختلفين لنفس الاسم باللغة الروسية واللغة الأوكرانية، وهي قاعدة تنطبق في حال عدم وجود أي رغبة يُعبّر عنها الشخص المعني صراحة عما يخالف ذلك.

The provisions of this Convention apply to the use of electronic communications in connection with the formation or performance of a contract or agreement to which any of the following international conventions, to which a Contracting State to this Convention is or may become a Contracting State, apply:

1. The provisions of this Convention apply to the use of electronic communications in connection with the formation or performance of a contract to which any of the following international conventions, to which a Contracting State to this Convention is or may become a Contracting State, apply:
1 - تنطبق أحكام هذه الاتفاقية على استخدام الخطابات الإلكترونية في سياق تكوين أو تنفيذ عقد أو اتفاق تسري عليه أي من الاتفاقيات الدولية التالية، التي تكون الدولة المتعاقدة في هذه الاتفاقية، أو قد تصبح، دولة متعاقدة فيها:

In order to effectuate the exchange of information as provided in paragraph 1, each Contracting State shall take the necessary measures, including legislation, rule-making, or administrative arrangements, to ensure that its competent authority has sufficient powers under its domestic law to obtain information for the exchange of information, regardless of whether that Contracting State may need such information for its own tax purposes. "

Depending on the facts and circumstances of the particular case, a failure to disclose may eliminate the right of a Contracting State to invoke paragraph 3 (a) to avoid its obligations under paragraph 1. 16.4.
ووفقا للوقائع والظروف التي تحيط بالحالة المعينة، قد يفضي عدم الإفصاح إلى سقوط حق الدولة المتعاقدة في الاحتجاج بالفقرة 3 (أ) للتحلل من التزاماتها بموجب الفقرة 1.

In any event, a failure to provide timely notice of such a change may eliminate the right of a Contracting State to invoke paragraph 3 (a) to avoid its obligations arising under paragraph 1.
وعلى أية حال، فإن عدم تقديم إشعار في الوقت المناسب بشأن تغيير كهذا قد يلغي حق الدولة المتعاقدة في الاحتجاج بالفقرة 3 (أ) للتنصل من التزاماتها بموجب الفقرة 1.
