" (d) The requested State shall meet the costs of execution, except for the fees of experts, which shall be paid by the requesting State.
" (د) تتحمل الدولة المطلوب إليها تنفيذ الإنابة رسومها ما عدا أتعاب الخبراء فعلى الدولة الطالبة أداؤها ويرسل بها بيان مع ملف الإنابة.

A Council of Europe recommendation provides that " medical staff and ambulance workers from the requested State should be authorised to administer emergency treatment in the requesting state " .
وتنص توصية مجلس أوروبا على أن ' ' يرخص للموظفين الطبيين ومستخدمي سيارات الإسعاف من الدولة المطلوب إليها المساعدة بتقديم العلاج في حالات الطوارئ في الدولة الطالبة للمساعدة``().

" (c) If the letter rogatory cannot be executed or if it pertains to an action or a procedure that is precluded by the law of the requested State, the requested State shall inform the requesting authority about the situation and explain its reasons.
(ج) إذا تعذر تنفيذ الإنابة أو كانت الإنابة تتعلق بموضوع أو إجراء لا يجيزه قانون الدولة المطلوب إليها التنفيذ، تشعر الدولة المطلوب إليها التنفيذ السلطة الطالبة بذلك مع بيان الأسباب؛

8. If the legal system of the requested State does not permit extradition of its national, then it shall be obliged to prosecute whosoever commits a terrorist crime if the act is punishable in both States by a freedom restraining sentence for a minimum period of one year or more.
8 - إذا كان النظام القانوني للدولة المطلوب إليها التسليم لا يجيز لها تسليم مواطنيها، فتلزم الدولة المطلوب إليها التسليم بتوجيه الاتهام ضد من يرتكب منهم جريمة من الجرائم الإرهابية إذا كان الفعل معاقبا عليه في كل من الدولتين بعقوبة سالبة للحرية لا تقل مدتها عن سنة أو بعقوبة أشد.

Extradition, submission of a foreign offence for the purpose of prosecution and even mutual legal assistance traditionally depended on double criminality, meaning that the conduct for which cooperation is sought is a punishable offence under the laws of both the requested State and the charging State.
20- كان تسليم المجرمين وإحالة جرم أجنبي بقصد الملاحقة وحتى المساعدة القانونية متوقفاً عادة على التجريم المزدوج، بمعنى أن يكون السلوك الذي يلتمس التعاون بسببه جرماً يعاقَب عليه بموجب قوانين كل من الدولة المطلوب إليها والدولة الموجِّهة للاتهام.

" (d) The requested State shall bear the costs of execution of the letter rogatory, except for experts' fees, which shall be paid for by the requesting State. A list shall be sent together with the letter rogatory.
(د) تتحمل الدولة المطلوب إليها تنفيذ الإنابة رسومها ما عدا أتعاب الخبراء فعلى الدولة الطالبة أداءها ويرسل بها بيان مع ملف الإنابة، على أن للدولة المطلوب إليها تنفيذ الإنابة أن تتقاضى لحسابها وفقاً لقوانينها الرسوم المقررة على الأوراق التي تقدم في أثناء تنفيذ الإنابة.

h. If the legal system of the requested State does not allow it to extradite its nationals. In this case, the requested State shall prosecute any such persons who commit in any of the other Contracting States a terrorist offence that is punishable in both States by deprivation of liberty for a period of at least one year or more.
(ح) إذا كان النظام القانوني للدولة المطلوب إليها التسليم لا يجيز لها تسليم مواطنيها، فتلتزم الدولة المطلوب إليها التسليم بتوجيه الاتهام ضد من يرتكب منهم لدى أي من الدول المتعاقدة الأخرى جريمة من الجرائم الإرهابية؛ إذا كان الفعل معاقبا عليه في كل من الدولتين بعقوبة سالبة للحرية لا تقل مدتها عن سنة أو بعقوبة أشد.

However, this interpretation is to be set aside at least in those cases where the clause expressly specifies that the obligation to prosecute is subject to the existence of a prior request for extradition or to a further request made by the State seeking extradition for the requested State to prosecute the individual: these variants of the formula belong to the second category described hereinafter.

(e) If there has been an amnesty in either the requesting State or the State of which the request is made, as long as, in the latter case, the offence is one which can be prosecuted in that State when committed outside its territory by a non-national of that State.
