When a state witness is required to testify before the court of another country, States shall facilitate his or her transfer to the State requiring such testimony.
وحين يكون شاهد دولة ما مطلوبا للشهادة أمام محكمة بلد آخر ، على الدول أن تيسر نقله الى الدولة طالبة تلك الشهادة .

2. Where the accused person had been enslaved in the territory of the State requesting extradition;

3. Where the prescribed penalty under the law of the State requesting extradition is deemed to be socially unacceptable.

81- وتقدّم الفقرة 11 من المادة 16 للدول التي لا تستطيع تسليم رعايا خيارا آخر: إذ يجوز لها أن تسلّم أحد رعاياها بصورة مؤقتة إلى الدولة طالبة التسليم لغرض وحيد هو إجراء المحاكمة.

(c) The State requesting the issuance of a circular on the person in question is notified of the order for his or her arrest and of the need to send a certified copy of his extradition file, if deemed appropriate;

Article 2 of the Act furthermore provides that extradition is permitted in two cases: first, where the offence was committed in the State requesting the extradition or the perpetrator is a national of that State and, second, where the offence was committed outside the requesting State and it damaged that State's security, financial position or the authoritative nature of its official stamps.

1- متهماً بارتكاب جريمة وقعت داخل ارض الدولة طالبة التسليم أو خارجها وكانت قوانين الدولة الطالبة وقوانين جمهورية العراق تعاقب عليها بالسجن أو الحبس مدة لا تقل عن سنتين أو أية عقوبة أشد.

The Israeli courts merely assess whether there exists sufficient evidence against the wanted person to warrant bringing him to trial in the requesting State, to determine the question of his guilt or innocence.
