Article 12 commits States parties to take all appropriate measures to eliminate discrimination against women in the field of health care in order to ensure, on a basis of equality of men and women, access to health-care services, including those related to family planning, and to ensure to women appropriate services in connection with pregnancy.

The Convention prohibits discrimination against women in the political, economic, social, cultural, civil or any other field and obligates States parties to take all appropriate measures to ensure the full development and advancement of women.

It recalls its general comment No. 20 (1992), in which it recommends that States parties should make provision against incommunicado detention.

Article 10 differs in this respect from article 7, which requires States parties " to take positive measures to ensure that private persons or entities do not inflict torture or cruel, inhuman or degrading treatment or punishment on others within their power. "

In general comment 24 of the Committee on the Elimination of Discrimination against Women (CEDAW) it is stated that this places an obligation on States parties to take " appropriate legislative, judicial, administrative, budgetary, economic and other measures to the maximum extent of their available resources to ensure that women realize their rights to health care " .

The Convention also confers certain benefits upon women where they are integral to the enjoyment of rights by children, such as in article 24, which obliges States parties to take all appropriate measures to provide prenatal and post—natal care for expectant mothers, education relating, inter alia, to the advantages of breastfeeding and family planning education and services.

56. In its general comment No. 3 (1990), the Committee draws attention to the obligation of States parties to take steps, individually and through international assistance and cooperation, especially through economic and technical cooperation, with a view to achieving the full realization of the rights recognized in the Covenant.

Article 16, paragraph 1, of the Migrants Protocol lays down an obligation for States parties to take all appropriate measures to preserve and protect the internationally recognized rights of smuggled migrants, in particular the right to life and the right not to be subjected to torture or other cruel, inhuman or degrading treatment or punishment.

Article 25, paragraph 1, of the Convention, which obliges States parties to take appropriate measures within their means to provide assistance and protection to victims of trafficking, particularly in cases of retaliation and intimidation, draws on paragraph 6 (d) of the Declaration of Basic Principles for Victims of Crime and Abuse of Power, concerning protection against intimidation and retaliation.
