The State party also notes that the authors freely decided to invoke the clause in their contract that gave them the right to be provided with a return travel to Sri Lanka, which rendered difficult to pursue domestic remedies and therefore exonerates the State party's Government.

492. The Committee welcomes the State party's policy of inclusion of children with disabilities and notes the recently adopted policy relating to chronically ill children, including provisions for health, social security, education and finance.
492- ترحب اللجنة بالسياسة التي تتبعها الدول الطرف بإدماج الأطفال المعوقين، وتحيط علماً بالسياسة المعتمدة مؤخراً بشأن الأطفال المصابين بمرض مزمن، بما في ذلك الترتيبات المتخذة بشأن الصحة، والضمان الاجتماعي، والتعليم، والتمويل.

The State party's submission amounts to a challenge of the Committee's findings and should have been properly raised while the communication was under consideration by the Committee; this opinion was conveyed to the State party's representative in follow-up consultations during the fifty-ninth session.

Algeria, like all other States parties, would be able to observe that the Committee worked in a transparent way if a summary, similar to that prepared for the follow-up to Views, was drawn up by the Committee, with an indication of the question asked, a synopsis of the State party's reply, the Committee's evaluation and the follow-up given.
ويمكن للجزائر مثلها في ذلك مثل جميع الدول الأخرى التأكد من شفافية عمل اللجنة إذا ما وضعت اللجنة، مثلما تفعل بالنسبة إلى متابعة الآراء، جدولا تجميعيا يتضمن السؤال المطروح وموجزا لرد الدول الطرف ورأي اللجنة والمتابعة.

Although the State party's legislation provided in certain circumstances for the trial of an individual, because of his position, by a higher court than would normally be the case, this circumstance alone could not impair the defendant's right to review of his conviction and sentence by a court.
إذ رغم أن تشريع الدول الطرف ينص على أن محاكمة شخص ما يجب أن تتم، في ظل ظروف معينة، وبحكم منصبه، من جانب محكمة أعلى درجة عما يكون عليه الحال عادة، فإن هذا الظرف لا يمكن أن ينال في حد ذاته من حق المدعى عليه في إعادة النظر في إدانته والحكم الصادر ضده من جانب المحكمة.

36. The Committee is pleased to note that, pursuant to article 116 of the State party's Constitution, international treaties, including the Convention, take precedence over national legislation.
36- وتعرب اللجنة عن ارتياحها لملاحظة أن للمعاهدات الدولية، ومنها الاتفاقية، الغلبة على التشريع الوطني بموجب المادة 116 من دستور الدول الطرف.

5.2 As to the State party's argument that even if the arrest was illegal, this would not be sufficient to set aside a judgement rendered after a trial free from error, the author contests that the trial was free from such error.
5-2 وفيما يتعلق بحجة الدول الطرف أنه حتى إذا كان الاعتقال غير قانوني فإن ذلك لا يكفي لإلغاء حكم صدر بعد محاكمة خالية من العيوب، يعترض صاحب البلاغ على مسألة أن المحاكمة كانت خالية من العيوب.

568. The Committee welcomes the support of the State party to HIV/AIDS awareness campaigns.
568- ترحب اللجنة بدعم الدول الطرف لحملات التوعية بمرض الإيدز والعدوى بفيروسه.
