123. The Working Group discussed whether Contracting States that have made a declaration under article 96 should be encouraged to withdraw such declarations.

Such an interpretation would respect to a greater extent the intention of Contracting States that made declarations under draft articles 18 and 19, since the court of the forum State would be obliged to apply the convention only if the rules of private international law of the forum State led to the application of the law of the Contracting State.

3. The Contracting States that do not make extradition conditional on the existence of a treaty shall recognize the offences referred to in article 2 as extraditable offences between themselves subject to the conditions provided for by the law of the requested State.
٣ - على الدول المتعاقدة التي لا تعلق تسليم المجرمين على شرط وجود معاهدة، أن تعتبر الجرائم المشار إليها في المادة ٢ جرائم تستوجب التسليم فيما بينها، رهنا بالشروط المنصوص عليها في قوانين الدولة المقدم إليها الطلب.

4. Each Contracting State shall take such measures as may be necessary to establish its jurisdiction over the crimes referred to in article 2 in cases where the alleged offender is present in its territory and where it does not extradite such a person to any of the Contracting States that have established their jurisdiction in accordance with paragraphs 1 or 2.
٤ - تتخذ كل دولة متعاقدة ما يلزم من تدابير ﻹقامة ولايتها على الجرائم المشار إليها في المادة ٢ إذا كان المدعى ارتكابه الجريمة موجودا في إقليمها ولم تقم بتسليمه الى أي من الدول المتعاقدة التي أقامت ولايتها وفقا للفقرة ١ أو ٢.

Thus, judges located in Contracting States that declared an article 95 reservation will not apply the Convention by virtue of article 1 (1)(b); this does not, however, affect the Convention's applicability in those Contracting States by virtue of article 1 (1)(a).

254. As for the possibility that Contracting States which are not parties to the armed conflict could resort to the procedure in draft article 8, paragraph 1, his reading of the debate was that such extension of the right in question would not be desirable.
254- أما بشأن إمكانية أن تلجأ الدول المتعاقدة التي ليست أطرافاً في النزاع المسلح إلى الإجراء الوارد في الفقرة 1 من مشروع المادة 8، فإن فهمه للمناقشة التي دارت هو أن إعطاء الحق المشار إليه لن يكون أمراً مستحسناً.

Paragraph 2 was added following a proposal whereby, inter alia, " the Contracting States which make extradition conditional on the existence of a treaty shall recognize the present Convention as the legal basis for extradition " (emphasis added).
