645. The representative of the United States of America orally amended the draft resolution by adding at the end of paragraph 5 (f) the words " recognizing that States not party to the Rome Statute of the International Criminal Court have no obligations under the Statute " .
645- وعدّل ممثل الولايات المتحدة الأمريكية شفوياً مشروع القرار مضيفاً في نهاية الفقرة 5(و) عبارة نصها كما يلي: " ومع التسليم بأن الدول غير الأطراف في نظام روما الأساسي للمحكمة الجنائية الدولية لا تقع عليها التزامات بموجب هذا النظام " .

The Relationship Agreement approved under General Assembly resolution 58/318 did not bind States not parties to the Rome Statute to the financial implications of the Court's activities and required full reimbursement of all expenses incurred by the United Nations.

Even resolution 1593 (2005), which Mr. Moreno-Ocampo and others use as a fall-back, is not binding on the Government of the Sudan because it clearly affirms in paragraph 2 that " that States not party to the Rome Statute have no obligation under the Statute " , although it also " urges all States and concerned regional and other international organizations to cooperate fully " .

However, the International Criminal Court as constituted was heavily subordinate to the decisions of the Security Council and hence hostage to the threat of a veto by one of the Council's permanent members, with the result that States not parties to the Rome Statute could exercise control over the work of the Court, undermining assurances that the Court would not act in a selective, politicized and discriminatory manner.
