Accordingly, the Special Rapporteur believes that the regime described is not fully in conformity with the provisions of the Body of Principles for the Protection of All Persons under Any Form of Detention or Imprisonment, Principle 18 of which states as follows:

While the United Nations Body of Principles for the Protection of All Persons under Any Form or Detention or Imprisonment does not use the term custody, it sets forth the following associated definitions:
٠٢١- وبينما لا تستخدم عبارة الحراسة في مجموعة المبادئ المتعلقة بحماية جميع اﻷشخاص الذين يتعرضون ﻷي شكل من أشكال الاحتجاز أو السجن، فإن المجموعة تبين التعاريف التالية ذات الصلة:

Such conditions of detention also violate provisions contained in the United Nations Standard Minimum Rules for the Treatment of Prisoners, the Basic Principles for the Treatment of Prisoners and the Body of Principles for the Protection of All Persons under Any Form of Detention or Imprisonment.

For the Working Group her detention at Asmara prison and her subsequent house arrest are in contravention of articles 9, 10 and 19 of the Universal Declaration of Human Rights and of principles 10 to 12 of the Body of Principles for the Protection of All Persons under Any Form of Detention or Imprisonment.

This constitutes a violation of articles 9 and 10 of the Universal Declaration of Human Rights and of principles 10, 11, 12, 13, 15, 16, 17, 18, 19 and 33 of the Body of Principles for the Protection of All Persons under Any Form of Detention or Imprisonment which is of such gravity as to confer on the deprivation of liberty an arbitrary character.

(a) Body of Principles for the Protection of All Persons under Any Form of Detention or Imprisonment;

Principle 18 of the Body of Principles for the Protection of All Persons under Any Form of Detention or Imprisonment provides that, save in exceptional circumstances, the right to confidential communication between legal counsel and his or her client may not be suspended.
وتنص المادة ٨١ من مجموعة المبادئ المتعلقة بحماية جميع اﻷشخاص الذين يتعرضون ﻷي شكل من أشكال الاحتجاز أو السجن على أنه لا يجوز وقف الحق في الاتصال بسرية بين المحامي القانوني وموكله، إلا في ظروف استثنائية.

46. The Special Rapporteur believes that Chilean legislation should comply with the following provisions of the Body of Principles for the Protection of All Persons under Any Form of Detention or Imprisonment:
٦٤- ويرى المقرر الخاص ضرورة أن يمتثل التشريع الشيلي لﻷحكام التالية من مجموعة المبادئ المتعلقة بحماية جميع اﻷشخاص الذين يتعرضون ﻷي شكل من أشكال الاحتجاز أو السجن:

The domestic law should take into consideration, in this regard, the provisions contained in Principle 18 of the Body of Principles for the Protection of All Persons under Any Form of Detention or Imprisonment, as well as paragraph 8 of the Basic Principles on the Role of Lawyers.

Conditions in Myanmar prisons seem to fall short of international standards; i.e., the Standard Minimum Rules for the Treatment of Prisoners; the Basic Principles for the Treatment of Prisoners and the Body of Principles for the Protection of All Persons under Any Form of Detention or Imprisonment.
ويبدو أن اﻷوضاع في سجون ميانمار هي دون المعايير الدولية، أي القواعد النموذجية الدنيا لمعاملة السجناء؛ والمبادئ اﻷساسية لمعاملة السجناء؛ ومجموعة المبادئ لحماية جميع اﻷشخاص الذين يتعرضون ﻷي شكل من أشكال الاحتجاز أو السجن.
