Article 3 in each Covenant affirms that States undertake to ensure the equal right of men and women to the enjoyment of all the rights set forth in the Covenant concerned.

Thus, article 2 imposes the obligation on States to respect and ensure this right on the basis of the principle of non-discrimination, while article 3 requires them to undertake to ensure the equal right of men and women to the enjoyment of freedom of movement.

First, the Committee explicitly sets forth the equal right of men and women to the enjoyment of economic, social and cultural rights as " a mandatory and immediate obligation of States parties " that is non-derogable.

He questioned the reasoning behind Kuwait's reservations to article 3 of the Covenant, which affirmed the equal right of men and women to the enjoyment of all civil and political rights set forth in the Covenant, and to article 23, which guaranteed equality of rights and responsibilities of spouses as to marriage, on the ground that those articles were incompatible with Islamic law, in particular with regard to polygamy.

Articles 2.2 and 3 of the Covenant stipulate that States parties undertake to guarantee that the rights enunciated in the Covenant must be exercised without discrimination of any kind as to race, colour, sex, language, religion, political or other opinion, national or social origin, property, birth or other status, and to ensure the equal rights of men and women to the enjoyment of all the rights set forth in the Covenant.

9. The Committee on Economic, Social and Cultural Rights achieved a major advance in its work during its thirty-fourth session (2005) when it adopted general comment No. 16 on article 3 of the Covenant on the equal right of men and women to the enjoyment of all economic, social and cultural rights.
9- أحرزت اللجنة المعنية بالحقوق الاقتصادية والاجتماعية والثقافية تقدماً رئيسياً في عملها أثناء دورتها الرابعة والثلاثين (2005) عندما اعتمدت التعليق العام رقم 16 بشأن المادة 3 من العهد المتعلقة بتساوي الرجال والنساء في حق التمتع بجميع الحقوق الاقتصادية والاجتماعية والثقافية.

In 2005, the Special Rapporteur made contributions to the drafting by the Committee on Economic, Social and Cultural Rights of general comment No. 16 on article 3 of the Covenant concerning " The equal right of men and women to the enjoyment of all economic, social and cultural rights " .

7. Concerning article 3 of the Covenant, and the equal right of men and women to the enjoyment of all economic, social and cultural rights set out therein, she called attention to articles 12 (2), 35 (1) and 36 of the Slovak Constitution, and more especially to article 38 (1), which prescribed affirmative action in regard to the health at work and working conditions of women, minors and persons with impaired health.
٧- وفيما يتعلق بالمادة ٣ من العهد المتصلة بكفالة مساواة الرجال والنساء في حق التمتع بجميع الحقوق الاقتصادية والاجتماعية والثقافية المكرسة في العهد، استرعت الانتباه إلى المواد ٢١)٢( و٥٣)١( و٦٣ من الدستور السلوفاكي، وبصفة أخص إلى المادة ٨٣)١( التي تنص على اتخاذ إجراء إيجابي فيما يتعلق بالرعاية الصحية للعاملين وبشروط العمل المتاحة للنساء والقاصرين واﻷشخاص المصابين بعوق صحي.

The Constitution, under the above-mentioned article 11, has ensured the equal right of men and women to enjoy all civil and political rights set forth in the Covenant.
