In this regard, the State party is encouraged to develop procedures and criteria to determine the best interests of the child in every area, and to disseminate them to the public or private social welfare institutions, courts of law, administrative authorities and legislative bodies.
وفي هذا الصدد، تحثّ اللجنة الدولة الطرف على وضع إجراءات ومعايير لتحديد مصالح الطفل الفضلى في المجالات كافة كما تحثها على نشرها على مؤسسات الرعاية الاجتماعية العامة أو الخاصة والمحاكم والسلطات الإدارية والهيئات التشريعية.

فالمودعون هم اﻷحداث الذين تقل أعمارهم عن الثامنة عشرة والذين يعتبرون في عداد اﻷطفال بموجب اتفاقية حقوق الطفل، وبمقتضى هذه الاتفاقية فان اﻷطفال يجب أن يتمتعوا برعاية وعناية خاصتين وأن تراعى مصالحهم الفضلى في جميع الاجراءات التي تتعلق بهم، سواء قامت بها مؤسسات الرعاية الاجتماعية العامة أو الخاصة أو المحاكم أو غيرها من الهيئات.
