• VII of the Convention

It is quite encouraging to note that by now the vast majority of States parties have now established a National Authority as required under Article VII of the Convention.
ومن المشجع أن نلاحظ الآن أنّ الأغلبية الساحقة من الدول الأطراف قد أنشأت سلطة وطنية وفقا للمادة السابعة من الاتفاقية.

22. Article VII of the Convention states:

With respect to the latter, experts on mission travelling on official business are also entitled to speedy travel facilities in accordance with article VII of the Convention.
إذ يحق للخبراء في البعثات الذين يسافرون في مهام رسمية، في ما يتعلق بالتوصية الأخيرة، الحصول على تسهيلات سريعة للسفر طبقا للمادة السابعة من الاتفاقية.

The application of article VII of the Convention obviously clashes with the stricter interpretation of article II (2) since, according to that interpretation, article II (2) establishes a uniform rule of formal validity, which thus prevails over national form requirements.
ومن الواضح أن تطبيق المادة السابعة من الاتفاقية يتضارب مع التفسير الأشد صرامة للفقرة 2 من المادة الثانية، لأن هذه الفقرة، وفقاً لذلك التفسير، ترسي قاعدة موحّدة للصحة الشكلية، تكون لها بالتالي غلبة على الاشتراطات الشكلية الواردة في الأحكام الوطنية.

A second solution could be to rely on the more-favourable-law provision of article VII of the Convention.
ويمكن اللجوء الى حل ثان بالاعتماد على الحكم الذي يسمح باللجوء الى القانون اﻷنسب مما تنص عليه المادة السابعة من الاتفاقية .

1. Article VII of the Convention

Member States agreed on and unequivocally reaffirmed the validity and the crucial importance of the Convention and, with an eye to the future, approved two important action plans: one on the implementation of article VII of the Convention, and another on the universality of the Convention.
إذ اتفقت الدول الأعضاء وأكدت مجددا وبكل وضوح على صلاحية المعاهدة وأهميتها الحيوية، وتحسبا للمستقبل وافقت على خطتي عمل هامتين، إحداهما بشأن تنفيذ المادة السابعة من الاتفاقية والأخرى بشأن عالمية الاتفاقية.

19. The Group noted that, as at 30 June 1994, 213 reports were overdue and that, since its last session held from 25 to 29 January 1993, no reports had been submitted to it under article VII of the Convention.
٩١ - وأشار الفريق إلى أنه حتى ٠٣ حزيران/يونيه ٤٩٩١ كان هناك ٣١٢ من التقارير التي فات موعد تقديمها، وأنه منذ دورته اﻷخيرة المعقودة من ٥٢ إلى ٩٢ كانون الثاني/يناير ٣٩٩١ لم تقدَم إليه أي تقارير بموجب المادة السابعة من الاتفاقية.

The law enables the full implementation and enforcement of the provisions of the Chemical Weapons Convention and fulfills Pakistan's obligations under Article VII of the Convention mandating national implementing measures.

1. Article V and section 25, paragraphs 1 and 2 (I), of article VII of the Convention shall extend to the representatives of Associate Members participating in the work of the Organization in accordance with the Statutes of the World Tourism Organization (hereinafter referred to as " the Statutes " ).
1 - تشمل الأحكام الواردة في المادة الخامسة والفقرتين 1 و 2 ' 1` من البند 25 من المادة السابعة من الاتفاقية ممثلي الأعضاء المنتسبين الذين يشاركون في أعمال المنظمة وفقا للأنظمة الأساسية لمنظمة السياحة العالمية (يشار إليها فيما يلي باسم " الأنظمة الأساسية " ).

1. Article VII of the Convention determines that " Each State Party to this Convention undertakes to provide or support assistance, in accordance with the United Nations Charter, to any Party to the Convention which so requests, if the Security Council decides that such Party has been exposed to danger as a result of violation of the Convention " .
1- تنصّ المادة السابعة من الاتفاقية على ما يلي: " تتعهد كل دولة من الدول الأطراف في هذه الاتفاقية بتوفير أو تيسير المساعدة الموجهة وفقاً لميثاق الأمم المتحدة إلى أية دولة من الدول الأطراف في الاتفاقية تطلب ذلك، إذا قرر مجلس الأمن أن الدولة المذكورة تتعرض للخطر نتيجة لخرق الاتفاقية " .

Another helpful route might be through Article VII of the Convention itself, which provides, in effect, that the provisions of the Convention shall not “deprive any interested party of any right he may have to avail himself of an arbitral award in the manner and to the extent allowed by law or the treaties of the country where such award is sought to be relied upon”.
وقد يتأتى هناك طريق مفيد من خلال المادة السابعة من الاتفاقية نفسها ، والتي تنص بالفعل على أن أحكام الاتفاقية " لا تحرم أيا من اﻷطراف المهتمة من أي حق يكون له في الاستفادة من أي قرار تحكيمي على نحو والى الحد اللذين يسمح بهما قانون أو معاهدات البلد الذي يسعى فيه الى الاحتجاج بهذا القرار " .

Although the form requirement was not at issue in this case, the decision may serve as an indicator that the courts will probably interpret article VII of the Convention so that it applies also to recognition of arbitration agreements and not only to recognition of arbitral awards, i.e., that the courts will allow the parties to avail themselves of the more favourable provisions of the Arbitration Act.
ورغم أن اشتراط الشكل لم يكن موضع خلاف في هذه القضية، فإن القرار قد يكون مؤشرا على أن من الممكن أن تُفسّر المحاكم المادة السابعة من الاتفاقية تفسيرا يجعلها تنطبق أيضا على الاعتراف باتفاقات التحكيم وليس الاعتراف بقرارات التحكيم فحسب، أي أن المحاكم ستسمح للأطراف بالاستفادة من أحكام قانون التحكيم المواتية بقدر أكبر.
