While noting that persons held in detention in Bangladesh were often subjected to mistreatment by police personnel, the Board expressed its view that this was not an abuse that was sanctioned by the Bangladeshi authorities.

4.8 As regards BNP supporters' alleged ill-treatment of the complainant in 1995, the State party submits that there is nothing to indicate that the Bangladeshi authorities had anything to do with it at all, or that the complainant has anything to fear from the parties currently in power.
4-8 وتؤكد الدولة الطرف فيما يتعلق بادعاء تعرض صاحب الشكوى لإساءة معاملة مناصري الحزب القومي البنغلاديشي في عام 1995، أنه لا يوجد ما يشير إلى أن السلطات البنغلاديشية كانت متورطة في هذا الحادث، أو أنه يوجد ما يدعو صاحب الشكوى إلى الخوف من أحزاب الائتلاف الحاكمة الآن.

6.4 In respect of the State party's suggestion that the complainant is not of interest to the Bangladeshi authorities since he could move about in the country while being charged with murder, counsel submits that his movements were limited, and that because Bangladesh did not have a centralized data system he was not apprehended by the police before 1999.
6-4 وفيما يتعلق بقول الدولة الطرف إن صاحب الشكوى لا يثير اهتمام السلطات البنغلاديشية بما أنه تمكن من التنقل داخل البلد وهو متهم بالقتل، يؤكد المحامي أن تنقلاته كانت محدودة وأن الشرطة لم تلق القبض عليه قبل عام 1999 لأنه لا يوجد في بنغلاديش نظام بيانات مركزي.

Furthermore, the Bangladeshi authorities are neither willing nor able to protect LGBT individuals because homosexual acts are illegal under domestic law (section 377 of the Criminal Code).
