10- اذا لم تقم الدولة الطرف التي يوجد الجاني المزعوم في اقليمها بتسليم ذلك الشخص فيما يتعلق بجرم تنطبق عليه هذه المادة، لسبب وحيد هو كونه أحد مواطنيها، وجب عليها، بناء على طلب الدولة الطرف التي تطلب التسليم، أن تحيل القضية دون ابطاء لا مسوغ له الى سلطاتها المختصة بقصد الملاحقة.

3. Diplomatic protection shall not be exercised by the present State of nationality in respect of a person against a former State of nationality of that person for an injury incurred when that person was a national of the former State of nationality and not of the present State of nationality.
3- لا يجوز لدولة الجنسية الحالية أن تمارس الحماية الدبلوماسية، فيما يخص شخصاً ما، ضد دولة الجنسية السابقة لذلك الشخص فيما يتعلق بضرر لحق به عندما كان من رعايا دولة الجنسية السابقة ولم يكن من رعايا دولة الجنسية الحالية.

Where an injured person has undergone a bona fide change of nationality following an injury, the new State of nationality may exercise diplomatic protection on behalf of that person in respect of the injury, provided that the State of original nationality has not exercised or is not exercising diplomatic protection in respect of the injured person at the date on which the change of nationality occurs.
1 - عندما يغير شخص* مضار جنسيته بحسن نية إثر ضرر، يجوز لدولة الجنسية الجديدة أن تمارس الحماية الدبلوماسية نيابة عن ذلك الشخص فيما يتعلق بالضرر، شريطة ألا تكون دولة الجنسية الأصلية قد مارست أو لا تمارس حاليا الحماية الدبلوماسية فيما يتعلق بالشخص المضار وقت تغيير الجنسية.

Immediate family member, in relation to a person, means someone who is related to the person concerned by blood, marriage, adoption or affinity.
ويعني الوضع الأسري حالة الشخص فيما يتعلق بمسؤوليته عن رعاية أحد أفراد الأسرة المباشرين، ويقصد به الشخص الذي تربطه بالشخص المعني وشيجة دم أو زواج أو تبن أو صلة قربى.
