Where the law requires that a contract or any other communication, declaration, demand, notice or request that the parties are required to make or choose to make in connection with a contract should be in writing, that requirement is met by a data message if the information contained therein is accessible so as to be usable for subsequent reference.
" 2- حيثما يشترط القانون أن يكون العقد، أو أي بلاغ أو إعلان أو مطالبة أو إشعار أو طلب آخر يتعيّن على الأطــراف اجــراؤه أو يختارون اجراءه فيما يتصــل بالعقد، كتابيا، يكون ذلك الشرط مستوفى برسالة البيانات إذا كان من الممكن الوصول إلى المعلومات الواردة فيها على نحو يتيح استخدامها للرجوع اليها لاحقا.

" 3. Where the law requires that a contract or any other communication, declaration, demand, notice or request that the parties are required to make or choose to make in connection with a contract should be signed, or provides consequences for the absence of a signature, that requirement is met in relation to a data message if:
" 3- حيثما يشترط القانون أن يكون العقد، أو أي بلاغ أو إعلان أو مطالبة أو إشعار أو طلب آخر يتعيّن على الأطراف إجراؤه أو يختارون اجراءه فيما يتصل بالعقد، موقّعا، أو ينص على آثار تترتب على عدم وجود توقيع، يكون ذلك الشرط مستوفى فيما يتعلق برسالة البيانات إذا:

" 3. Where the law requires that a communication or a contract should be signed by a party, or provides consequences for the absence of a signature, that requirement is met in relation to an electronic communication if a method is used to identify the party and to indicate that party's intention in respect of the information contained in the electronic communication, provided that:
" 3- حيثما يشترط القانون أن يكون الخطاب أو العقد ممهورا بتوقيع طرف ما، أو ينص على عواقب لعدم وجود توقيع، يعتبر ذلك الشرط مستوفى فيما يخص الخطاب الالكتروني، إذا استخدمت طريقة لتعيين هوية الطرف المعني ولتحديد قصد ذلك الطرف فيما يتعلق بالمعلومات الواردة في الخطاب الالكتروني، شريطة:

(1) Where the law requires a signature of a person, that requirement is met in relation to a data message if an electronic signature is used which is as reliable as was appropriate for the purpose for which the data message was generated or communicated, in the light of all the circumstances, including any relevant agreement.
(1) حيثما يشترط القانون وجود توقيع من شخص، يُعد ذلك الشرط مستوفى بالنسبة إلى رسالة البيانات إذا استُخدم توقيع الكتروني موثوق به بالقدر المناسب للغرض الذي أنشئت أو أبلغت من أجله رسالة البيانات، في ضوء كل الظروف، بما في ذلك أي اتفاق ذي صلة.
