320. The view was expressed that if a State of origin could not prevent altogether a particular kind of significant transboundary harm, its duty was to minimize both the probability and the magnitude of such harm.

IV. Prevention and liability 17. A number of comments from Governments addressed the need for the Commission to study the question of liability, which was in their opinion closely related to the topic of prevention of significant transboundary harm.
