States Parties agree to facilitate and accept, without delay, the return of a person who has been smuggled contrary to the terms of this Protocol who is a national of that State Party or who had the right of abode in the territory of that State Party at the time of entry into the receiving State.
١- توافق الدول اﻷطراف على أن تيسر وتقبل، دون تأخير، اعادة أي شخص جرى تهريبه خلافا ﻷحكام هذا البروتوكول، اذا كان من مواطني تلك الدولة الطرف أو كان يتمتع بحق الاقامة في اقليم تلك الدولة الطرف وقت دخوله اقليم الدولة المستقبلة.

الى أوطانهم ١ - توافق كل دولة طرف على أن تيسر وتقبل ، دون ابطاء ، عودة ضحية الاتجار باﻷشخاص ، الذي يكون من مواطني تلك الدولة الطرف ، أو كان يتمتع ، بحق الاقامة في اقليم تلك الدولة الطرف وقت دخوله الى الدولة المستقبلة .

(b) The offence is committed on board a vessel that is flying the flag of that State Party or an aircraft that is registered under the laws of that State Party at the time that the offence is committed. [; or]
(ب) عندما يرتكب الجرم على متن سفينة ترفع علم تلك الدولة الطرف أو طائرة مسجّلة بمقتضى قوانين تلك الدولة الطرف وقت ارتكاب الجرم.() [؛ أو]

(b) The offence is committed on board a vessel that is flying the flag of that State Party or an aircraft that is registered under the laws of that State Party at the time that the offence is committed.
(ب) عندما يرتكب الجرم على متن سفينة ترفع علم تلك الدولة الطرف أو طائرة مسجّلة بمقتضى قوانين تلك الدولة الطرف وقت ارتكاب الجرم.

38. The Committee notes with concern the declaration entered by the State Party at the time of ratification of the Convention, in particular its wording that acceptance of the Convention does not imply the acceptance of obligations going beyond the constitutional limits, nor the acceptance of any obligations to introduce judicial processes beyond those provided in the Constitution.
38- تلاحظ اللجنة بقلق الإعلان الصادر عن الدولة الطرف وقت التصديق على الاتفاقية، لا سيما صيغته التي تفيد بأن قبول الاتفاقية لا يعني ضمنياً قبول الالتزامات التي تتجاوز الحدود الدستورية، ولا قبول أي التزامات بإحداث عمليات قضائية تتجاوز العمليات المنصوص عليها في الدستور.
