In its general comment relating to the principle of non-discrimination, the Human Rights Committee pointed out that States Parties should, if necessary, take affirmative action in order to diminish or eliminate conditions which cause or help to perpetuate discrimination prohibited by the Covenant.
٢٥ - وقد أشارت اللجنة المعنية بحقوق الانسان، في تعليقها العام فيما يتصل بمبدأ عدم التمييز، الى أن الدول اﻷطراف ينبغي أن تتخذ، عند الضرورة، اجراءات إيجابية للتقليل من الظروف التي تتسبب أو تساعد في إدامة التمييز الذي يحظره العهد، أو للقضاء على تلك الظروف.

In its General Comment on non-discrimination the Committee points out that: " ... the principle of equality sometimes requires States parties to take affirmative action in order to diminish or eliminate conditions which cause or help to perpetuate discrimination prohibited by the Covenant.
ففي تعليقها العام بشأن عدم التمييز ذكرت اللجنة " أن مبدأ المساواة يتطلب أحيانا من الدول الأطراف أن تتخذ إجراءات إيجابية للتقليل من الظروف التي تتسبب أو تساعد في إدامة التمييز الذي يحظره العهد أو إنهائها.

The Human Rights Committee adopted the same position in its general comment No. 18: " The Committee also wishes to point out that the principle of equality sometimes requires States parties to take affirmative action in order to diminish or eliminate conditions which cause or help to perpetuate discrimination prohibited by the Covenant.
وقد أوردته لجنة حقوق الإنسان في تعليقها العام رقم 18 الذي جاء فيه ما يلي: " ترغب اللجنة أيضا الإشارة إلى أن مبدأ المساواة يتطلب أحيانا من الدول الأطراف أن تتخذ إجراءات إيجابية للتقليل من الظروف التي تتسبب أو تساعد في إدامة التمييز الذي يحظره العهد أو للقضاء على تلك الظروف.

HRC has indicated that " the principle of equality sometimes requires States parties to take affirmative action in order to diminish or eliminate conditions which cause or help to perpetuate discrimination " . (HRC general comment No. 18, para. 10).
وقد أشارت اللجنة المعنية بحقوق الإنسان إلى أن " مبدأ المساواة يتطلب أحياناً من الدول الأطراف أن تتخذ إجراءات تصحيحية للتقليل من الظروف التي تتسبب أو تساعد في إدامة التمييز ... أو للقضاء على تلك الظروف " (الفقرة 10 من التعليق العام رقم 18 للجنة المعنية بحقوق الإنسان).

6.10 Similarly, the author cannot avail himself of paragraph 10 of general comment No. 18 to justify the derogation which he is claiming, as it states that " the principle of equality sometimes requires States parties to take affirmative action in order to diminish or eliminate conditions which cause or help to perpetuate discrimination prohibited by the Covenant " .
