As regards A/CN.9/WG.I/WP.58, the Working Group considered the draft text for the Guide to Enactment addressing publication of procurement-related opportunities, provisions addressing the use of electronic communications in procurement (including electronic submission and opening of tenders) and those addressing abnormally low tenders.

The Working Group decided to accommodate the use of electronic communications and technologies (including electronic reverse auctions) as well as the investigation of abnormally low tenders in the Model Law and to continue at its eighth session the in-depth consideration of those topics and consequential revisions to the Model Law, on the basis of drafting materials that the Secretariat would prepare (A/CN.9/575, para. 9).

It was further observed that intentional ALTs might also arise if suppliers sought a contract at any price, for example, if they were seeking to secure credit and avoid insolvency.
ولوحظ كذلك أن العطاءات المنخفضة الأسعار انخفاضا غير عادي والمتعمدة قد تنشأ عن سعي المورّدين إلى الحصول على عقد بأي ثمن، كما في حالة السعي إلى الحصول على ائتمان وتفادي الإعسار.

75. The Secretariat was requested to propose the appropriate location for the provisions, taking into account that the issue should not be limited to tendering proceedings, and that risks of ALTs should be examined and addressed by the procuring entity at any stage of the procurement, including through qualification of suppliers.
75- وطُلب إلى الأمانة أن تقترح الموضع المناسب لتلك الأحكام، آخذة بعين الاعتبار ألا تُحصر المسألة في إجراءات المناقصة وأنه ينبغي للجهة المشترية أن تدرس مخاطر العطاءات المنخفضة الأسعار انخفاضا غير عادي وتعالجها في أي مرحلة من عملية الاشتراء، بما في ذلك من خلال تأهُّل المورّدين.

The Working Group agreed that the Guide should highlight the importance of adequate examination of tenders for their responsiveness and supplier for their solvency, of precise and detailed specifications and of objective criteria, for identifying and rejecting ALTs.
واتفق الفريق العامل على أن الدليل ينبغي أن يبرز أهمية فحص العطاءات بصورة كافية لمعرفة مدى استجابتها للشروط وفحص القدرة المالية للمورّدين، وفحص المواصفات الدقيقة والتفصيلية، وفحص المعايير الموضوعية، لتحديد العطاءات المنخفضة الأسعار انخفاضا غير عادي ورفضها.

It was also said that the procuring entity, by intentionally not reserving such a right in the solicitation or equivalent documents, could open the possibility of accepting ALTs to accommodate the interests of some suppliers, and that this situation should be avoided.
وقيل كذلك إن الجهة المشترية، إذا تعمّدت عدم ذكر احتفاظها بهذا الحق في وثائق الالتماس أو ما يعادلها من وثائق، فقد تتيح إمكانية قبول العطاءات المنخفضة الأسعار انخفاضا غير عادي لخدمة مصالح بعض الموردين، وإن من الضروري تفادي مثل هذه الحالة.

It was also questioned whether linking ALTs only to the risk of performance of procurement contracts, as the draft currently did, was sufficient.
53- واستُفسِر أيضا عما إذا كان من الكافي ربطُ العطاءات المنخفضة الأسعار انخفاضا غير عادي بمخاطرة تنفيذ عقود الاشتراء لا غير، مثلما هو وارد في الصيغة الحالية.

The Working Group was also informed that, in some jurisdictions, the risks of ALTs were also addressed by legislation that provided for suppliers to be held accountable for their tenders or other bids.
73- وأُبلغ الفريق العامل أيضا بأن مخاطر العطاءات المنخفضة الأسعار انخفاضا غير عادي تُعالَج أيضا في بعض الولايات القضائية بتشريعات تنص على تحميل المورّدين مسؤولية ما يقدمونه من عطاءات أو عروض أخرى.
