Owing to the rapid development of space and aviation technology, which gives aircraft the capacity to reach certain parts of outer space, the definition of outer space and airspace by international customary law will provide a guideline for State practices in this area and reduce conflicts in the interpretation of the law.
السؤال (أ)- نظراً لتطوّر تكنولوجيا الفضاء والطيران تطوّراً سريعاً، يتيح للطائرة قدرة على الوصول إلى أجزاء معيّنة من الفضاء الخارجي، من شأن تعريف الفضاء الخارجي والفضاء الجوي في القانون العرفي الدولي أن يوفّر إرشادات لممارسات الدول في هذا المجال وأن يقلل من التضارب في تفسير القانون.

In order to adequately deal with situations arising from the development or utilization of aerospace objects (for example, activities in foreign airspace), it is necessary for the international community to take measures to establish universally accepted principles and parameters leading to the definition of boundaries between outer space and airspace.
3- وبغية التصدي على نحو مناسب للحالات الناجمة عن استحداث أو استخدام أجسام فضائية جوية (على سبيل المثال لدى الاضطلاع بأنشطة في الفضاء الجوي الأجنبي)، من الضروري أن يتخذ المجتمع الدولي تدابير لوضع مبادئ وبارامترات مقبولة عالميا تؤدي إلى تعريف الحدود بين الفضاء الخارجي والفضاء الجوي.

The view was expressed that an agreement on a clear definition of the boundaries between outer space and airspace would allow the Committee and the Subcommittee to concentrate on developing and improving legal instruments that applied to activities that were not restricted to one single realm of space and would create the legal certainty that was needed to provide commercial operators with the necessary assurances to carry out their activities.
77- وأَعرب أحد الوفود عن رأي مفاده أنَّ من شأن الاتفاق على تعريف واضح للحدود بين الفضاء الخارجي والفضاء الجوي أن يتيح للجنة وللجنة الفرعية التركيز على وضع وتطوير صكوك قانونية تنطبق على أنشطة لا تقتصر على جانب واحد من الجوانب المتعلقة بالفضاء، وأن يهيئ اليقين القانوني اللازم لتزويد مشغلي التجهيزات الفضائية التجارية بالضمانات اللازمة للاضطلاع بأنشطتهم.
