In this regard, the Special Rapporteur recalls article 12 of the Convention on the Rights of Child, which provides that States Parties shall assure to the child who is capable of forming his or her own views the right to express those views freely in all matters affecting the child, the views of the child being given due weight in accordance with the age and maturity of the child.
وتذكِّر المقررة الخاصة، في هذا الصدد، بالمادة 12 من اتفاقية حقوق الطفل التي تنص على أن تكفل الدول الأطراف في الاتفاقية للطفل القادر على تكوين آرائه الخاصة حق التعبير عن تلك الآراء بحرية في جميع المسائل التي تمس الطفل، وتولي آراء الطفل الاعتبار الواجب وفقاً لسن الطفل ونضجه.

The court is always obliged to inquire about the view of a minor child who is able to formulate its views, namely in every judicial proceedings concerning the child.
وتُلزم المحكمة دوماً بفحص آراء الطفل القاصر القادر على تكوين آرائه، وذلك في جميع الإجراءات القضائية المتعلقة بالطفل.

In such circumstances, it was essential to ensure that the child was treated in a manner consistent with the promotion of his or her sense of dignity and worth and that decisions were clearly taken in the light of the best interests of the child, in a due process that gave the child who was capable of forming his or her own views the right to express those views freely.
فمن المهم جدا في حالات كهذه ضمان معاملة الطفل على نحو يتماشى مع تنمية شعور الطفل بكرامته وقدره وأن تكون القرارات متخذة بالفعل من منطلق تحقيق مصالح الطفل الفُضلى، في إطار عملية قانونية تخول الطفل القادر على تكوين آرائه الشخصية الحق في التعبير عن هذه اﻵراء بحرية.

Paragraph 1 assures, to every child capable of forming his or her own views, the right to express those views freely in all matters affecting the child.
وتكفل الفقرة 1 للطفل القادر على تكوين آرائه الخاصة حق التعبير عن تلك الآراء بحرية في جميع المسائل التي تمسه.

" 1. States Parties shall assure to the child who is capable of forming his or her own views the right to express those views freely in all matters affecting the child, the views of the child being given due weight in accordance with the age and maturity of the child.

However, article 12 expressly articulates States Parties' obligations to " assure to the child who is capable of forming his or her own views the right to express those views freely in all matters affecting the child, the views of the child being given due weight in accordance with the age and maturity of the child " .
غير أن المادة 12 تنص صراحة على أن ' ' تكفل الدول الأطراف في الاتفاقية للطفل القادر على تكوين آرائه الخاصة حق التعبير عن تلك الآراء بحرية في جميع المسائل التي تمس الطفل، وتولي آراء الطفل الاعتبار الواجب وفقا لسن الطفل ونضجه``.

25. Paragraph 1 of the article accords to the child who is capable of forming his or her views the right to express those views freely in all matters affecting him or her, and the subsequent right to have those views given due weight in accordance with his or her age and maturity.
٢٥ - فالفقرة 1 من المادة تمنح الطفل القادر على تكوين آرائه الخاصة حق التعبير عن هذه الآراء بحرية في جميع المسائل التي تمس الطفل، والحق التالي المتعلق بإيلاء آراء الطفل الاعتبار الواجب وفقا لسنه ونضجه.

Under article 8 of that Act, the child who is able to formulate its own view, is entitled, for the purpose of the social and legal protection, to express such views freely in discussions related to any matters which concern the child, even in the absence of its parents or other persons responsible for the child's upbringing.
وبموجب المادة 8 من هذا القانون، يحق للطفل القادر على تكوين آراءه الخاصة، لغرض الحماية الاجتماعية والقانونية، أن يُعرب عن هذه الآراء بحرية في المناقشات المتعلقة بأية مسائل تهم الطفل، حتى في غياب والديه أو الأشخاص الآخرين المسؤولين عن تنشئة الطفل.
