It was with great sorrow that the Tribunal received the news that former judge Jules Deschênes passed away on 10 May 2000, at the age of 76.

219. On 4 June 2007, at a Solemn Sitting held by the Court, the President paid tribute to the memory of Mr. Kéba Mbaye, former judge and VicePresident of the Court, who passed away in January 2007.

3. Upon the death of a married former judge who was entitled to a retirement pension, his or her surviving spouse, provided he or she was his or her spouse at the date his or her service ended, shall be entitled to a surviving spouse’s pension calculated as follows:

Upon the death of a married former judge who was in receipt of a disability pension, his or her surviving spouse, provided he or she was his or her spouse at the date that his or her service ended, shall be entitled to a surviving spouse’s pension amounting to one half of the pension which his or her spouse was receiving, provided that the surviving spouse's pension shall not be less than three eighths of the annual pension.

On 8 April, in a retrial, a panel of one local and two EULEX judges at Pejë/Peć Basic Court sentenced Isa Salihi, a former employee of the Guarantee Fund of Kosovo, to two years of imprisonment for having taken advantage of his office or official authority to assist former judge Kolë Puka in issuing unlawful judicial decisions and thereby acquiring a benefit for himself or another person.

The Special Rapporteur refers to the report of the Special Rapporteur on extrajudicial, summary or arbitrary executions in relation to the case of the death of an ex-member of the judiciary, José Vicente Gonzalez, a former judge, who reportedly died by the hands of the military in December 1995 after having received death threats on various occasions (E/CN.4/1997/60/Add.1, para. 188).
