The criminal legislation of Azerbaijan provides for responsibility for terrorism in article 214 of the Criminal Code of Azerbaijan.

An analysis carried out of similar laws in European states found that sanctions provided for in the Criminal Code of Azerbaijan are in line with similar sanctions in other member states of the Council of Europe.

73. Although torture is defined in terms similar to those of article 1 of the 1984 Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, the definition of the Azerbaijani Criminal Code does not reflect entirely the internationally agreed definition of torture.
73- وإن كان التعذيب يُعرَّف بعبارات تشبه عبارات المادة 1 من اتفاقية عام 1984 لمناهضة التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة، فإن التعريف الوارد في القانون الجنائي لأذربيجان لا يتجلى فيه تماماً تعريف التعذيب المتفق عليه دوليا.

Under articles 228-232 of the Criminal Code of Azerbaijan, criminal liability attaches to the unlawful acquisition, transfer, sale, storage, transport or carrying of firearms or components thereof, ammunition, explosive substances and explosive devices.
وتجرم المواد 228-232 من القانون الجنائي لأذربيجان حيازة الأسلحة النارية ومكوناتها والذخائر والمواد المتفجرة والأجهزة المتفجرة أو نقل ملكيتها أو بيعها أو تخزينها أو نقلها أو حملها بصورة غير مشروعة.

A number of provisions of the Criminal Code of Azerbaijan were applicable to instances of human trafficking, including slavery, forced confinement, trafficking in human organs, abduction, kidnapping, compulsion to sexual activities, involvement of minors into prostitution, trafficking in minors, illegal adoption, compulsion to prostitution and running dens.

1.1 Article 214-1 of the Criminal Code of Azerbaijan adopted on 1 September 2000 specifies penalties for the financing of terrorism.
1-1 تحدد المادة 214-1 من القانون الجنائي لأذربيجان المعتمدة في 1 أيلول/سبتمبر 2000 عقوبات تمويل الإرهاب.

In this connection, persons are liable under the Criminal Code of Azerbaijan and entities are liable under the above-mentioned Counter-Terrorism Act.
وفي هذا الصدد، يحمل الأشخاص المسؤولية عن ذلك بموجب القانون الجنائي لأذربيجان وتكون الكيانات مسؤولة بموجب قانون مكافحة الإرهاب المشار إليه أعلاه.

Under article 12.3 of the Criminal Code of Azerbaijan, persons who commit terrorist acts, regardless of the place of commission of the crime, may be tried and sentenced on the basis of the said Criminal Code.
فالمادة 12-3 من القانون الجنائي لأذربيجان تقضي بأن الأشخاص الذين يرتكبون أعمالا إرهابية، بصرف النظر عن مكان ارتكاب الجريمة، يمكن محاكمتهم ومعاقبتهم بناء على القانون الجنائي المذكور.

Failure to report on known grave or particularly grave crimes that were being planned or have been committed, as well as wilful concealment of such crimes, entails criminal liability in accordance with article 307 of the Criminal Code of Azerbaijan.
ويستتبع عدم الإبلاغ عن الجرائم الخطيرة المعروفة أو الجرائم الخطيرة بشكل خاص التي تم التخطيط لها أو ارتكبت، فضلا عن إخفاء هذه الجرائم عن عمد، المسؤولية الجنائية وفقا للمادة 307 من القانون الجنائي لأذربيجان.

The Government reports that a separate proceeding was conducted on 22 November 2012 in relation to the criminal case relating to charges against Abdoli Ali Hamzali, under article 276 of the Criminal Code of Azerbaijan.
38- وتفيد الحكومة أن دعوى منفصلة رُفعت في 22 تشرين الثاني/نوفمبر 2012 وهي تتصل بالدعوى الجنائية التي رفعت ضد عبدولي علي حمزالي بموجب المادة 276 من القانون الجنائي لأذربيجان.

On 30 December 1999, the Parliament adopted the law ratifying the Criminal Code of Azerbaijan, its entering into force and legal adjusting matters related thereto.
وفي 30 كانون الأول/ديسمبر 1999، اعتمد البرلمان القانون المتعلق بالتصديق على القانون الجنائي لأذربيجان ودخوله حيز النفاذ وما يتصل بذلك من مسائل التعديلات القانونية.

Article 82.3 of the Criminal Code of Azerbaijan provides that the sanction of a person sentenced to life imprisonment may be replaced by way of pardon with imprisonment for a term not exceeding 25 years.
وتنص المادة 82-3 من القانون الجنائي لأذربيجان على أنه يجوز الاستعاضة عن عقوبة شخص محكوم عليه بالسجن المؤبد بالعفو مع السجن لمدة لا تتجاوز 25 عاما.

In order to implement article 2, paragraph 4, of the Convention, the necessary changes were introduced in articles 27.2 and 27.3 of the Criminal Code of Azerbaijan so that an attempt to commit a crime, being considered equivalent to an incomplete offence, is punishable under the procedure providing for liability for the commission of crimes under the relevant articles of the Criminal Code.
وبغية تنفيذ الفقرة 4 من المادة 2 من الاتفاقية، أدخلت التعديلات اللازمة في المادتين 27-2 و27-3 من القانون الجنائي لأذربيجان حيث أن أي شخص يحاول ارتكاب جريمة تعتبر معادلة لجرم غير كامل يعاقب بموجب الإجراءات التي تنص على تحمل المسؤولية إزاء ارتكاب الجرائم بموجب المواد ذات الصلة من القانون الجنائي.

On 21 June 2012, Mr. Mammadov was arrested by the Nasimi District Police pursuant to article 234.4.3 of the Criminal Code of Azerbaijan in relation to illegal manufacture, purchase, storage, transfer, transport or sale of drugs in a large quantity.
6- وفي 21 حزيران/يونيه 2012، قام أفراد من شرطة منطقة النسيمي باعتقال السيد مامادوف عملاً بالمادة 234-4-3 من القانون الجنائي لأذربيجان بتهمة القيام على نحو غير مشروع بتصنيع كمية كبيرة من المخدرات أو شرائها أو تخزينها أو تحويلها أو نقلها أو بيعها.

In addition, officials who use their official position out of personal interest to the detriment of the interests of service or fail to perform or improperly perform their duties or manifest an unscrupulous or neglectful attitude towards their duties may, as prescribed by law, be brought to justice in accordance with articles 308 and 314 of the Criminal Code of Azerbaijan.
وبالإضافة إلى ذلك، يجوز تقديم الموظفين الذين يستخدمون منصبهم الرسمي لمصلحتهم الخاصة على حساب مصالح الخدمة، أو الذين لا يؤدون واجباتهم أو يؤدونها بصورة غير مناسبة، أو يظهرون موقفا من مواقف عدم المبالاة أو الإهمال إزاء واجباتهم، إلى العدالة، وفق ما نص عليه القانون، وطبقا للمادتين 308 و 314 من القانون الجنائي لأذربيجان.

Notwithstanding the fact that the law allows for the possibility of applying the death penalty in the case mentioned above, the " death penalty " is not mentioned as a type of punishment in article 42 of the Criminal Code of Azerbaijan (which lists all forms of punishment), nor is the application of this type of punishment reflected in any article of the Code.
وبالرغم من أن القانون يسمح بإمكانية تطبيق عقوبة الإعدام في الحالة المذكورة أعلاه، فإن " عقوبة الإعدام " غير مذكورة كشكل من أشكال العقاب في المادة 42 من القانون الجنائي لأذربيجان (الذي يتضمن جميع أشكال العقاب)، ولا يتجلى هذا النوع من العقاب في أية مادة من مواد هذا القانون.

On 28 November 2012, Mr. Mammadov's lawyers reported that their client was facing two sets of accusations: " illegal selling of drugs " on the one hand, and " high treason " and " incitement to national, racial, social and religious hatred and hostility " on the other hand, under articles 234.4.3, 274 and 283 of the Criminal Code of Azerbaijan, respectively.
49- وفي 28 تشرين الثاني/نوفمبر 2012، أفاد محامو السيد مامادوف أن موكلهم يواجه مجموعتين من الاتهامات تتعلق الأولى ببيع المخدرات بصورة غير مشروعة من جهة، وبالخيانة العظمى والحض على الكراهية والعداوة القومية والعنصرية والاجتماعية والدينية من جهة أخرى بموجب المواد 234-4-3 و274 و283 من القانون الجنائي لأذربيجان على التوالي.

Articles 206.2-206.4 of the Criminal Code of Azerbaijan envisage criminal penalties in the form of 3 to 12 years' imprisonment for violating customs regulations and for the smuggling of radioactive and explosive substances and equipment, weapons, military hardware, nuclear, chemical, biological and other types of weapons of mass destruction, as well as materials and equipment used in the manufacture of such weapons.
فالمادتان 206-2 و 206-4 من القانون الجنائي لأذربيجان توقعان عقوبات جنائية في شكل السجن لفترة تتراوح بين 3 سنوات و 12 سنة على انتهاك الأنظمة الجمركية وتهريب المواد والأجهزة المشعة والمتفجرة والأسلحة والعتاد العسكري، والأسلحة النووية والكيميائية والبيولوجية والأنواع الأخرى من أسلحة الدمار الشامل وكذلك المواد والمعدات المستخدمة في تصنيع هذه الأسلحة.

5.1 On 28 April 2011, the author submits that the State party had confirmed that the initial death sentence had been imposed on him based not only on the Azerbaijani Criminal Code, but also on provisions from the Criminal Codes of the Russian Soviet Federative Socialist Republic and of the Georgian Soviet Socialist Republic.
5-1 في 28 نيسان/أبريل 2011، دفع صاحب البلاغ بأن الدولة الطرف قد أكدت أن حكم الإعدام الأولي لم يصدر في حقه بالاستناد إلى القانون الجنائي لأذربيجان فقط، بل صدر أيضاً بالاستناد إلى أحكام من القانونين الجنائيين لجمهورية روسيا الاتحادية الاشتراكية السوفياتية وجمهورية جورجيا الاشتراكية السوفياتية.
