I wish to point out with emphasis that gaps in international law and practice - failure to uphold international law and human rights, or upholding them in one situation and closing our eyes to their violation in others - must no longer be acceptable behaviour, particularly in the new world order to which we all aspire.
وأود أن أوضح مع التشديد أن الفجوات في القانون والممارسة الدوليين - وأقصد عدم التمسك بالقانون الدولي وحقوق اﻹنسان، أو التمسك بها في حالـة وإغمـاض أعيننـا عـن انتهـاكهـا في حالات أخرى - لا ينبغي أن تكون سلوكا مقبولا بعد اﻵن، وبخاصة في النظام العالمي الجديد الذي نطمح فيه جميعا.

Since the Working Group held that on this point the domestic law is at variance with international law and practice, it made the following recommendation in its report on the visit (E/CN.4/2004/3/Add.2): " The active involvement of counsel must be provided for, whatever the nature of the case, starting with the custody, or, the very least, the investigation phase, throughout the trial and the appeals stage. "
ولأن الفريق رأى أن القانون المعمول به في إيران يختلف في هذه النقطة مع القانون والممارسة الدوليين فإنه قدم التوصية التالية في تقريره عن الزيارة: " يجب أن ينص القانون على إشراك محامٍ إشراكاً فعالاً، أياً كانت طبيعة القضية، ابتداءً من الوضع في الحجز أو على الأقل في مرحلة التحقيق وطيلة المحاكمة وفي مرحلة الاستئناف " .
