It was also recalled that in the case concerning Military and Paramilitary Activities in and against Nicaragua, the International Court of Justice had held that the provision of strictly humanitarian assistance to persons or forces in another country, whatever their political affiliations or objectives, could not be regarded as unlawful intervention or as in any other way contrary to international law.

In relation to the question of the facts to be clarified, the Court in the case concerning Military and Paramilitary Activities in and against Nicaragua, (Merits) stated that:

Moreover, it had indicated that it preferred contemporaneous evidence from persons with direct knowledge of the facts or realities and that it would give particular attention to reliable evidence acknowledging facts or conduct unfavourable to the State represented by the person making them, thereby echoing the remarks it had made almost 20 years earlier in the case concerning Military and Paramilitary Activities in and against Nicaragua.

On the other hand, the International Court of Justice has not itself been precluded from deciding whether aggression has been committed in a specific case, as is shown by the case concerning Military and paramilitary activities in and against Nicaragua, where the Court found that certain facts constituted use of force prohibited by the Charter of the United Nations and customary international law.

All disaster relief operations must respect the fundamental principles of humanity, neutrality and impartiality as defined by the 20th International Conference of the Red Cross and Red Crescent and endorsed by the International Court of Justice in its judgment in the case concerning Military and Paramilitary Activities in and against Nicaragua (Nicaragua v. United States of America).
