2 - ينبغي للدولة الموجه إليها طلب التسليم التي ترفض تسليم مواطنيها أن تقوم، بناء على طلب الدولة التي تطلب التسليم، بعرض القضية على سلطاتها المختصة لمباشرة الإجراءات القضائية إذا اقتضى الأمر.
