Such clauses are contrary to Article 101 of the Charter of the United Nations, United Nations Financial Regulation 3.11 and article 3.1 of the Financial Rules for Voluntary Funds administered by the High Commissioner for Refugees.

66. The Board further observed that UNHCR could not use the available funds if their usage was specifically restricted under the Financial Rules for Voluntary Funds Administered by the High Commissioner and if those rules did not contain any provision concerning funding the termination benefit fund.

21. To cover temporary shortfalls pending the receipt of anticipated contributions, the organization resorted to the Working Capital and Guarantee Fund in accordance with the provisions of article 6.4 (f) of the Financial Rules of the Voluntary funds administered by the High Commissioner for Refugees (A/AC.96/503/Rev.7).

كما نرى أن المعاملات المالية التي أجرتها مفوضية الأمم المتحدة لشؤون اللاجئين، التي أحطنا بها علما أو التي اختبرناها كجزء من عملية مراجعتنا للحسابات تتفق، من جميع جوانبها الرئيسية، مع القواعد المالية لصناديق التبرعات التي يديرها مفوض الأمم المتحدة السامي لشؤون اللاجئين والسلطة القانونية.
