Under article XXXI (8) of the Israeli-Palestinian Interim Agreement on the West Bank and the Gaza Strip signed in 1995,10 the Gaza Strip and the West Bank constitute a single territorial unit. “Safe passages” should have been opened between those parts of the occupied territories for the movement of persons, vehicles and goods.

It should be emphasized that the interim Agreement explicitly prohibits the parties from changing " the status of the West Bank and Gaza Strip pending the outcome of the permanent status negotiations " (article XXXI; 7, emphasis added).

Why did that matter? While the two clauses were largely similar -- indeed article XXXI of the Pact of Bogotá used the same wording as Article 36, paragraph 2, of the Statute -- Colombia's declaration under Article 36, paragraph 2, unlike that under the Pact of Bogotá, had expressed a reservation.

3. In addition, the Republic of Nicaragua requests the Court to reject the request of the Republic of Colombia to declare the controversy submitted to it by Nicaragua under article XXXI of the Pact of Bogotá " ended " , in accordance with articles VI and XXXIV of the same instrument.

207. In addition, Costa Rica submits that the Court has jurisdiction in accordance with the provisions of Article 36, paragraph 1, of its Statute, by virtue of the operation of article XXXI of the American Treaty on Pacific Settlement ( " Pact of Bogotá " ), signed on 30 April 1948.

This approach was later endorsed by the Court itself in the Border and Transborder Armed Actions (Nicaragua v. Honduras) case, in which Honduras sought to have its reservation to its declaration of acceptance of the compulsory jurisdiction of the Court under the optional clause take precedence over its obligations by virtue of article XXXI of the Pact of Bogotá.
