It was suggested that the link between the draft convention and the registration system could be established by way of a provision along the lines of article X that would allow Contracting States to appoint a supervising authority and a registrar.
وأشير إلى أنه يمكن إقامة الصلة بين مشروع الاتفاقية ونظام التسجيل بواسطة حكم على غرار المادة سين يتيح للدول المتعاقدة أن تعيّن هيئة مشرفة وأمين سجل.

Various views were expressed as to the substance and placement of draft article X contained in the footnote to draft article 4.
33- أعرب عن آراء مختلفة بشأن مضمون وموضع مشروع المادة سين الواردة في حاشية المادة 4.

It was suggested that the text of draft article X should not appear as a footnote to article 4 but should be dealt with exclusively in the Guide, with appropriate explanations being given as to the various arguments that had been exchanged regarding that provision during the preparation of the Model Law.

The former article 26, now provisionally called “article X”, had been drafted as a jurisdictional issue.
وتمت صياغة الفقرة ٦٢ السابقة والمسماة اﻵن مؤقتا " المادة سين " ، باعتبارها مسألة تتعلق بالاختصاص .

It was also stated that States considering adoption of article X should be informed of the possibilities for parties to preserve their rights when article X had not been adopted, namely that a party could commence a national court proceeding or arbitration to protect its interests.
وأفيد أيضا بأنه ينبغي إبلاغ الدول التي تنظر في اعتماد المادة سين بالإمكانيات المتاحة للطرفين لكي يحافظا على حقوقهما عندما لا تعتمد المادة سين، وهي أن بإمكان الطرف المعني أن يبدأ إجراءً قضائيا أو تحكيميا وطنيا لحماية مصالحه.

A different view was that the requirement for the declaration to be in writing should be maintained as it related to other articles, such as article X in the footnote to article 4 and articles 10 and 11, and the need for certainty as to when conciliation proceedings had terminated.

It was suggested that while the word " written " should be deleted as a general matter, a State adopting article X might wish to require that termination be in writing since precision was required in determining when the conciliation ended so that the courts could properly determine the prescription period.
96- وارتئي أنه، بينما ينبغي حذف الكلمة " كتابيا " كمسألة عامة، فان الدولة التي تعتمد المادة سين قد ترغب في أن تشترط أن يكون الانهاء كتابيا، حيث ان الدقة مطلوبة في تحديد الوقت الذي ينتهي فيه التوفيق حتى يتسنى للمحاكم تحديد فترة التقادم على نحو صحيح.

With respect to paragraph 44, it was suggested that the Guide should alert enacting States to the risks that might result from the adoption of article X. It was generally agreed in response that the Guide should reflect the arguments exchanged both against and in favour of the adoption of article X, as reflected in paragraphs 33 and 34, above.

A number of suggestions were made. One suggestion was that the draft Guide should explain that States adopting a provision along the lines of draft article X, in the interest of certainty with respect to the time of suspension and resumption of limitation periods, might need to consider requiring a written declaration for the termination of conciliation.
168- أُبدي عدد من الاقتراحات تمثل أحدها في أن يوضح مشروع الدليل أن الدول التي تعتمد حكما على غرار مشروع المادة سين توخيا لليقين فيما يتعلق بوقف سريان فترات التقادم ومعاودة سريانها، قد تحتاج إلى النظر في اشتراط اعلان كتابي لانهاء التوفيق.

In addition to the proposals made at the Commission, it was suggested that paragraph (7) be optional for States, for example, providing for an opt-in mechanism modelled on article X as appended to article 4 of the UNCITRAL Model Law on Conciliation (A/CN.9/WG.II/WP.138, para. 68).

Noting that draft article X was a standard provision found in other UNCITRAL texts (see, e.g., article 32 of the United Nations Convention on the Carriage of Goods by Sea, 1978 (Hamburg Rules)), the Working Group adopted the substance of draft article X unchanged and referred it to the drafting group.
136- اذ أشار الفريق العامل الى أن مشروع المادة " سين " هو عبارة عن حكم قياسي موجود في نصوص أخرى صادرة عن الأونسيترال (انظر، مثلا، المادة 32 من اتفاقية الأمم المتحدة بشأن نقل البضائع عن طريق البحر، 1978 (قواعد هامبورغ))، اعتمد الفريق مشروع المادة " سين " من حيث المضمون بدون تغيير وأحالها الى فريق الصياغة.
