وفي الفقرة 322 اقترح المقرر الخاص إنشاء قسم ضمن إدارة تسجيل معاهدات الأمم المتحدة يكون مسؤولاً عن العثور على جميع المعاهدات المبرمة بين الشعوب الأصلية والدول وتجميعها وتسجيلها وترقيمها ونشرها.

He further stated that its Government was also opposed to the establishment of a section within the United Nations Treaty Registry in charge of compiling and publishing all treaties concluded between indigenous peoples and States.
كما قال إن حكومته تعترض كذلك على إنشاء فرع داخل سجل الأمم المتحدة للمعاهدات يتولى مهمة تجميع ونشر جميع المعاهدات المبرمة بين الشعوب الأصلية والدول.

In its resolution 1987/17, the Sub-Commission recommended the appointment of Mr. Miguel Alfonso Martínez as Special Rapporteur with the mandate of preparing a study on the treaties concluded between indigenous peoples and States in all parts of the world with regard to the contemporary significance of such treaties for all parties concerned.
138- أوصت اللجنة الفرعية، في قرارها 1987/17، بتعيين السيد ميغيل ألفونسو مارتينيز مقرراً خاصاً تسند إليه ولاية إعداد دراسة عن المعاهدات المبرمة بين الشعوب الأصلية والدول في كافة أنحاء العالم من حيث أهمية هذه المعاهدات في هذا العصر بالنسبة لجميع الأطراف المعنية.

148. (b) The establishment, at the earliest possible date, of a section within the United Nations Treaty Registry with responsibility for locating, compiling, registering, numbering and publishing all treaties concluded between indigenous peoples and States. Due attention should be given in this endeavour to securing access to the indigenous oral version of the instruments in question;
(ب) إنشاء قسم، في أقرب تاريخ ممكن، ضمن إدارة تسجيل معاهدات الأمم المتحدة، يكون مسؤولا عن العثور على جميع المعاهدات المبرمة بين الشعوب الأصلية والدول وتجميعها وتسجيلها وترقيمها ونشرها وبإيلاء الاعتبار اللازم في هذا الجهد لتأمين إمكانية الوصول إلى النسخة الشفوية الأصلية للصكوك المعنية؛

(e) To consider recommending that the Economic and Social Council request that the United Nations Treaty Section of the Office of Legal Affairs be charged with locating, compiling, registering, numbering and publishing all treaties concluded between indigenous peoples and States;
(ه) النظر في أن توصي المجلس الاقتصادي والاجتماعي بأن يطلب إلى قسم المعاهدات في الأمم المتحدة التابع لإدارة الشؤون القانونية أن يتولى مهمة تحديد مكان وجود جميع المعاهدات المبرمة بين الشعوب الأصلية والدول وتجميعها وتسجيلها وإحصائها ونشرها؛

123. Closer scrutiny of the provisions of treaties concluded between indigenous peoples and States also reveals that in most cases the subject of such treaties is common in international law, whatever the historical period considered; thus such treaties deal with questions of war/peace, trade provisions, protection of the subjects/citizens of each signatory party, and so forth.
123- ويوضح التمحيص الدقيق لأحكام المعاهدات المبرمة بين الشعوب الأصلية والدول أيضاً أنه في معظم الحالات يكون موضوع هذه المعاهدات مألوفاً في القانون الدولي، أياً كانت الفترة التاريخية موضوع الدراسة؛ وهكذا تعالج هذه المعاهدات مسائل الحرب/السلام، والأحكام التجارية وحماية رعايا/مواطني كل طرف موقع، وغير ذلك.
