The Ombudsman and Human Rights Office is the competent authority for the consideration of complaints relating to torture and ill-treatment. Working with other regulators, it seeks to ensure the correct outcome for all complaints. Acts of torture or ill-treatment are investigated by the prosecutors in various directorates and in reform and rehabilitation centres.
ويعد مكتب المظالم وحقوق الإنسان الجهة المختصة بالنظر في الشكاوى المتعلقة بالتعذيب أو سوء المعاملة إضافة إلى الجهات الرقابية الأخرى، حيث يتم التحقيق في الشكاوى حسب القانون بواسطة المدعين العامين في المكتب واتخاذ القرارات المناسبة إزاء كل شكوى، ويختص المكتب أيضا بالنظر في الشكاوى المتعلقة بأعمال التعذيب أو سوء المعاملة والتي يحقق فيها المدعون العامون في المديريات ومراكز الإصلاح والتأهيل.

The Committee requests that the State party provide in its next periodic report detailed statistical data, disaggregated by crime, ethnicity and gender, on complaints relating to torture and ill-treatment allegedly committed by law enforcement officials and on the related investigations, prosecutions, and penal and disciplinary sentences. Information is further requested on any compensation and rehabilitation provided to the victims.
49- وتطلب اللجنة من الدولة الطرف أن تقدّم في تقريرها الدوري القادم بيانات إحصائية مفصّلة مصنفة حسب الجريمة والعرق والجنس، عن الشكاوى المتعلقة بأعمال التعذيب وسوء المعاملة المرتكبة على أيدي موظفي إنفاذ القانون، وعن التحقيقات والملاحقات والعقوبات التأديبية والقانونية ذات الصلة، إلى جانب معلومات عن أي تعويض أو إعادة تأهيل للضحايا.

The Subcommittee regretted in particular the absence of information on incidents of violence among detainees and on complaints, investigation, prosecutions and convictions for acts of torture or ill-treatment.

28- تأسف اللجنة لعدم توفر بيانات كاملة ومعللة بشأن الشكاوى والتحقيقات والملاحقات القضائية والإدانات المتعلقة بأعمال التعذيب وسوء المعاملة التي يرتكبها المكلفون بإنفاذ القوانين وضباط الجيش وموظفو السجون والعاملون في خدمات الصحة النفسية.

States parties shall also make readily available to the victims all evidence concerning acts of torture or ill-treatment upon the request of victims, their legal counsel, or a judge.
وعلى الدول الأطراف أيضاً أن تتيح للضحايا على نحو ميسّر جميع الأدلة المتعلقة بأعمال التعذيب أو سوء المعاملة بناء على طلب الضحايا أو مستشارهم القانوني أو القاضي.

20. The Committee regrets the absence of comprehensive, disaggregated data on complaints, investigations, prosecutions and convictions related to acts of torture and ill-treatment attributed to security service agents, including gendarmes, police officers, prefectural guards and prison guards.

The State party should take all necessary measures to ensure that the right of inmates to complain can be fully exercised, including the lifting of any statute of limitations for acts of torture and ill - treatment; ensuring that inmates may avail themselves of legal representation to file complaints; establishing protection mechanisms against intimidation of witnesses; and reviewing all rulings limiting the right to claim compensation.
