The Committee also recommends that the State party's legislation in civil proceedings involving racial discrimination provide for a shift in the burden of proof once a prima facie case of racial discrimination has been made.

17. The Committee is concerned about the limited effectiveness of the racial discrimination complaint procedure before the Commission for Equality and Against Racial Discrimination (the competent body dealing with racial discrimination under Law 18/2004 which transposed the European Union Directive on racial discrimination).
17- ويساور اللجنة القلق بشأن محدودية فعالية إجراء تقديم الشكاوى المتعلقة بالتمييز العنصري إلى اللجنة المعنية بتحقيق المساواة ومناهضة التمييز العنصري (وهي الهيئة المختصة بالتصدي للتمييز العنصري بموجب القانون رقم 18/2004 الذي طبق توجيه الاتحاد الأوروبي بشأن التمييز العنصري).

The Ministry indicated that, in the future, it would be very alert to the manner in which local authorities administered the approval scheme and would continue its efforts to ensure that the local authorities do not violate national or international law regarding racial discrimination.
