وتنص المادة 8 من الإعلان العالمي لحقوق الإنسان لعام 1948 في هذا الصدد على ما يلي: " لكل شخص حق اللجوء إلى المحاكم الوطنية المختصة لإنصافه الفعلي من أي أعمال تنتهك الحقوق الأساسية التي يمنحها إياه الدستور أو القانون``.

31- لكل شخص الحق في اللجوء إلى المحاكم الوطنية المختصة لإنصافه الفعلي من أي أعمال تنتهك الحقوق الأساسية وحقوق الإنسان التي يعترف بها القانون الوطني أو الدولي، بما فيها الحقوق المتعلقة بالأراضي().
