1.32 In accordance with Article 97 of the Charter of the United Nations, the Secretary-General, who is appointed by the General Assembly upon the recommendation of the Security Council and who in turn appoints the staff, is the Chief Administrative Officer of the Organization.

It was explained that that was an exceptional case reflecting the Secretary-General's decision within his prerogatives and responsibilities as the Chief Administrative Officer of the Organization under the Charter of the United Nations (see ibid., paras. 4-5).

In this light, the Advisory Committee is of the view that the Secretary-General should continue to have responsibility to present the budgetary requirements of OIOS in accordance with his responsibilities as the Chief Administrative Officer of the Organization (Article 97 of the Charter of the United Nations).

(b) Confirm that the exercise of judicial review by the Dispute Tribunal and the Appeals Tribunal should be undertaken with full respect for the prerogatives of the General Assembly as well as for the role of the Secretary-General as the Chief Administrative Officer of the Organization and for his prerogatives and responsibilities under the Charter of the United Nations (para. 202);
(ب) التأكيد أنه ينبغي لمحكمة المنازعات ومحكمة الاستئناف إجراء المطالعات القضائية في إطار الاحترام التام لصلاحيات الجمعية العامة وكذلك لدور الأمين العام بصفته المسؤول الإداري الأول للمنظمة وللصلاحيات والمسؤوليات المنوطة به بموجب ميثاق الأمم المتحدة (الفقرة 202)؛

202. In view of the foregoing, the Secretary-General requests the General Assembly to confirm that the exercise of judicial review by the Dispute Tribunal and the Appeals Tribunal should be undertaken with full respect for the prerogatives of the General Assembly and for the role of the Secretary-General as the Chief Administrative Officer of the Organization and for his prerogatives and responsibilities under the Charter of the United Nations.
202 - وفي ضوء ما تقدم، يطلب الأمين العام إلى الجمعية العامة أن تؤكد أنه ينبغي لما تمارسه محكمة المنازعات ومحكمة الاستئناف من مراجعة للأحكام القضائية أن يُجرى مع الاحترام الكامل لصلاحيات الجمعية العامة، وللدور الذي يؤديه الأمين العام بصفته المسؤول الإداري الأول للمنظمة ولصلاحياته ومسؤولياته بموجب ميثاق الأمم المتحدة.
