On 30 July 1993, KUWAIT OIL COMPANY (K.S.C.) (“KOC” or the “Claimant”) filed with the United Nations Compensation Commission (the “UNCC” or the “Commission”) a claim referred to by the Claimant as the “Well Blowout Control Claim” (the “WBC Claim”).

The Governing Council also approved the report and recommendations of the Panel of Commissioners appointed to review the Well Blowout Control Claim put forward by the Kuwait Oil Company for the cost of extinguishing oil well fires (S/AC.26/1996/5 and S/AC.26/1996/5/Annex).
ووافق مجلس اﻹدارة أيضا على تقرير وتوصيات فريق المفوضين المعيﱠن لاستعراض " المطالبة المتعلقة بمكافحة حرائق آبار النفط " التي تقدمت بها شركة النفط الكويتية لتغطية تكلفة إطفاء حرائق آبار النفط )S/AC.26/1996/5 و (S/AC.26/1996/5/Annex.

The Panel has previously reviewed evidence supplied by the claimant on this issue and found that these assertions are correct (see report on the Well Blowout Control Claim S/AC.26/1996/5/Annex paragraph 36, p.12; paragraph 85, p.26).

In these circumstances the Panel determines that 80 per cent of the common KOC - Al-Awda costs are to be verified in the WBC Claim.

The Panel finds, following the decision of the panel in the WBC Claim, / that such damage is compensable.
ويخلص الفريق إلى أن هذا الضرر قابل للتعويض بناء على مقرر الفريق في المطالبة المتعلقة بمكافحة حرائق آبار النفط(45).

The documentation that would enable the Panel to perform such verification is presented in KOC’s Physical Assets Claim and thus is not before this Panel, which was appointed to review the WBC Claim only.

The Panel determines that the loss, damage or injury for which compensation is being sought in the WBC Claim is compensable in this Claim in the amount of US$610,048,547.
١٤- يقرر الفريق أن الخسارة أو الضرر أو اﻷذى الذي يُطلب التعويض بصدده في المطالبة المتعلقة بمكافحة حرائق آبار النفط يستحق التعويض في إطار هذه المطالبة بمبلغ قدره ٧٤٥ ٨٤٠ ٠١٦ دولاراً.

The bulk of the costs claimed in the WBC Claim were incurred in United States dollars.
٢٤- إن الجزء اﻷعظم من التكاليف المطالب بها في إطار المطالبة المتعلقة بمكافحة حرائق آبار النفط يمثل تكاليف تم تكبدها بدولارات الولايات المتحدة.
