16.4 In the instant case and on the basis of the information before it, the Committee concludes that execution by gas asphyxiation, should the death penalty be imposed on the author, would not meet the test of " least possible physical and mental suffering " , and constitutes cruel and inhuman treatment, in violation of article 7 of the Covenant.
٦١-٤ وفي هذه القضية، وعلى أساس المعلومات المعروضة على اللجنة، تخلص اللجنة الى أن الاعدام خنقا بالغاز، في حالة توقيع عقوبة الاعدام على صاحب البلاغ، لن يفي بمعيار احداث " أقل درجة ممكنة من المعاناة البدنية والعقلية " ، وانه يشكل معاملة قاسية ولا إنسانية، تنتهك المادة ٧ من العهد.

11. The Committee's majority is of the view that judicial execution by gas asphyxiation, should the death penalty be imposed on Mr. Ng, would not meet the test of the " least possible physical and mental suffering " , and thus would constitute cruel and inhuman treatment in violation of article 7 of the Covenant (paragraph 16.4).
١١ - من رأي أغلب أعضاء اللجنة أن الاعدام بموجب حكم قضائي عن طريق الخنق بالغاز في حالة الحكم بالاعدام على السيد نغ لن يلبي معيار تحقيق " أقل درجة ممكنة من المعاناة البدنية والعقلية " ، ومن ثم فسيشكل معاملة قاسية ولاإنسانية تنتهك المادة ٧ من العهد )الفقرة ٦١-٤(.

Although any judicial execution must be carried out in such a way as to cause the least possible physical and mental suffering (see the Committee's general comment 20 (44) on article 7 of the Covenant), physical and mental suffering will inevitably be one of the consequences of the imposition of the death penalty and its execution.
ولئن كان ينبغي تنفيذ أي إعدام بموجب حكم قضائي بطريقة تسبب أقل درجة ممكنة من المعاناة البدنية والعقلية )انظر تعليق اللجنة العام ٠٢)٤٤( على المادة ٧ من العهد(، فإن المعاناة البدنية والعقلية ستكون لا محالة احدى نتائج توقيع عقوبة اﻹعدام وتنفيذها.

I am unable to concur with the views of the Committee that " execution by gas asphyxiation ... would not meet the test of'least possible physical and mental suffering'and constitutes cruel and inhuman [punishment] in violation of article 7 of the Covenant " (paragraph 16.4).
لا أستطيع الموافقة على آراء اللجنة القائلة إن " الاعدام خنقا بالغاز لن يفي بمعيار تحقيق " أقل درجة ممكنة من المعاناة البدنية والعقلية " ، كما يشكل ]عقوبت[ قاسية ولا إنسانية تنتهك المادة ٧ من العهد " )الفقرة ٦١ ٤(.

The phrase " least possible physical and mental suffering " comes from the Committee's general comment 20 (44) on article 7, which states that the death penalty must be carried out in such a way as to cause the least possible physical and mental suffering.
إن جملة " أقل درجة ممكنة من المعاناة البدنية والعقلية " تأتي من تعليق اللجنة العام رقم ٠٢)٤٤( على المادة ٧، الذي ينص على أن عقوبة الاعدام ينبغي أن تنفذ بطريقة تسبب أقل درجة ممكنة من المعاناة البدنية والعقلية.

None the less, the Committee reaffirms, as it did in its general comment 20(44) on article 7 of the Covenant that, when imposing capital punishment, the execution of the sentence " must be carried out in such a way as to cause the least possible physical and mental suffering " . n/
