29. The Isle of Man, within the restraints of its available resources, is taking steps towards achieving progressively the full realization of the rights recognized in the present Covenant.

Any person whose rights and freedoms as recognized in the Covenant are violated has an effective remedy, notwithstanding that the violation has been committed by persons acting in an official capacity.
فأي شخص تنتهك حقوقه أو حرياته المعترف بها في هذا العهد يتاح له سبيل فعال للتظلم والانتصاف حتى لو ارتكب هذا الانتهاك أشخاص يتصرفون بصفتهم الرسمية.

1. In accordance with article 16 of the Covenant, the States parties shall submit to the Council for consideration by the Committee reports on the measures which they have adopted and progress made in achieving the observance of the rights recognized in the Covenant.
1- وفقاً للمادة 16 من العهد، تقدم الدول الأطراف إلى المجلس تقارير لتنظر فيها اللجنة بشأن التدابير التي تكون قد اتخذتها والتقدم المحرز على صعيد احترام الحقوق المعترف بها في هذا العهد.

1. The States Parties to the present Covenant undertake to submit in conformity with this part of the Covenant reports on the measures which they have adopted and the progress made in achieving the observance of the rights recognized herein.
1- تتعهد الدول الأطراف في هذا العهد بأن تقدم، طبقاً لأحكام هذا الجزء من العهد، تقارير عما اتخذته من تدابير وما أحرزته من تقدم لضمان احترام الحقوق المعترف بها في هذا العهد.

3. Developing countries, with due regard to human rights and their national economy, may determine to what extent they would guarantee the economic rights recognized in the present Covenant to non-nationals.
3- للبلدان النامية أن تقرر، مع إيلاء المراعاة الواجبة لحقوق الإنسان ولاقتصادها القومي، إلى أي مدى ستضمن الحقوق الاقتصادية المعترف بها في هذا العهد لغير المواطنين.

As the preamble stipulates " the individual, having duties to other individuals and to the community to which he belongs, is under a responsibility to strive for the promotion and observance of the rights recognized in the present Covenant " , the authors believe that they do have standing before the Human Rights Committee.
وبما أن الديباجة تنص على أن " على الفرد، الذي تترتب عليه واجبات إزاء الأفراد الآخرين وإزاء الجماعة التي ينتمي إليها، مسؤولية السعي إلى تعزيز ومراعاة الحقوق المعترف بها في هذا العهد " ، فإن أصحاب البلاغ يعتقدون أن هناك ما يبرر عرض قضيتهم على اللجنة المعنية بحقوق الإنسان.

The Committee reminds the State party of its obligations under article 2, paragraph 2, of the Covenant, whereby it has to take the necessary steps and adopt appropriate legislation as may be necessary to give effect to the rights recognized in the present Covenant.
وتذكّر اللجنة الدولة الطرف بالتزاماتها بموجب الفقرة 2 من المادة 2 من العهد، التي يجب عليها بموجبها أن تتخذ الخطوات اللازمة وتعتمد التشريعات المناسبة حسب الاقتضاء لتفعيل الحقوق المعترف بها في هذا العهد.

3. The above-mentioned rights shall not be subject to any restrictions except those which are provided by law, are necessary to protect national security, public order (ordre public), public health or morals or the rights and freedoms of others, and are consistent with the other rights recognized in the present Covenant.
٣- لا يجوز تقييد الحقوق المذكورة أعلاه بأية قيود غير تلك التي ينص عليها القانون، وتكون ضرورية لحماية اﻷمن القومي أو النظام العام أو الصحة العامة أو اﻵداب العامة أو حقوق اﻵخرين وحرياتهم، وتكون متمشية مع الحقوق اﻷخرى المعترف بها في هذا العهد.

381. The above-mentioned rights shall not be subject to any restrictions except those which are provided by the law, are necessary to protect national security, public order (ordre public), public health or morals or the rights and freedoms of others, and are consistent with the other rights recognized in the present Covenant.
382- لا يجوز تقييد الحقوق المذكورة أعلاه بأية قيود غير تلك التي ينص عليها القانون، وتكون ضرورية لحماية الأمن القومي أو النظام العام أو الصحة العامة أو الآداب العامة أو حقوق الآخرين وحرياتهم، وتكون متمشية مع الحقوق الأخرى المعترف بها في هذا العهد.

Also regarding economic rights, the International Covenant on Economic, Social and Cultural Rights in its article 2.3, includes the possibility for developing countries, " with due regard to human rights and their national economy " , to " determine to what extent they would guarantee the economic rights recognized in the present Covenant to non-nationals " .
وفيما يتعلَّق أيضاً بالحقوق الاقتصادية، ينصُّ العهد الدولي الخاص بالحقوق الاقتصادية والاجتماعية والثقافية، في مادته 2-3، على أن " للبلدان النامية أن تقرِّر، مع إيلاء المراعاة الواجبة لحقوق الإنسان ولاقتصادها القومي، إلى أي مدى ستضمن الحقوق الاقتصادية المعترف بها في هذا العهد لغير المواطنين " .

Similarly, the preambles to the International Covenant on Civil and Political Rights and the International Covenant on Economic, Social and Cultural Rights recognize that the individual is " under a responsibility to strive for the promotion and observance of the rights recognized in the present Covenant " .
وبالمثل تسلم ديباجتا العهد الدولي الخاص بالحقوق المدنية والسياسية والعهد الدولي الخاص بالحقوق الاقتصادية والاجتماعية والثقافية بأن " على الفرد مسؤولية السعي إلى تعزيز ومراعاة الحقوق المعترف بها في هذا العهد " .

7.6 The author also invokes article 2, paragraph 3, of the Covenant, under which States parties are required to ensure access to effective remedies for all individuals whose rights, as recognized in the Covenant, have been violated.

3. Economic, social and cultural rights are not similarly placed. Moreover, the difficulty of determining the core requirements of the rights in the Covenant is greatly exacerbated by the obligation in article 2 to achieve “progressively the full realization of the rights recognized in the ... Covenant”.
٣- أما الحقوق الاقتصادية والاجتماعية والثقافية فليست في نفس الوضع، يضاف إلى هذا أن صعوبة تحديد المتطلبات اﻷساسية للحقوق في العهد تتفاقم لدرجة كبيرة بالالتزام الوارد في المادة ٢ بتحقيق " ضمان التمتع الفعلي التدريجي بالحقوق المعترف بها في هذا العهد " .

Under article 2 of the Covenant, Israel has an obligation " to adopt such laws or other measures as may be necessary to give effect to the rights recognized in the present Covenant " and to " ensure that any person whose rights or freedoms as herein recognized are violated shall have an effective remedy " .
