52- تأييداً لمطالبتها بالتعويض عن الخسارة الناجمة عن عدم استخدام المعدات والآليات، قدمت الشركة رسالة مؤرخة 24 تشرين الثاني/نوفمبر 1991 موجهة إلى صاحب العمل العراقي تطلب فيها تعويضاً عن المعدات والآليات المتعاقد عليها وغير الموردة.

The Panel finds that, although the photographs do depict some damaged equipment, Agrocomplect failed to provide evidence of its ownership of, and the value of, the equipment and machinery.Notwithstanding Agrocomplect’s failure to meet the requisite evidentiary standards, the Panel requested its expert consultants to perform a valuation of the losses of equipment and machinery set forth in Agrocomplect’s claim.
