7.5 The Committee also notes that the State party has not attempted to address the restrictions imposed on the author.

In light of this, the Committee considered that the sanction of imprisonment imposed on the author was incompatible with article 19, paragraph 3, of the Covenant.
وبناءً على ما تقدم، رأت اللجنة أن عقوبة السجن المفروضة على صاحب البلاغ في هذه القضية تتعارض والفقرة 3 من المادة 19 من العهد.

It reduced the sentence imposed on the author from 12 to 11 years' imprisonment, excluding from the consideration of aggravating circumstances the fact that the author had been intoxicated at the time of the offence.
وقامت بخفض مدة العقوبة المفروضة على صاحب البلاغ من 12 إلى 11 سنة سجن، مستبعدة من النظر في الظروف المشددة كون أن صاحب البلاغ كان ثملاً في وقت وقوع الجريمة.

In light of the finding that the death penalty imposed on the author is in violation of article 6, the Committee considers that it is not necessary to examine issues regarding the method of execution.
وبناء على استنتاج أن عقوبة الإعدام المفروضة على صاحب البلاغ تنتهك المادة 6، ترى اللجنة أن من غير الضروري دراسة المسائل المتعلقة بطريقة الإعدام.

The severity of the sanctions imposed on the author cannot be considered as a proportionate measure to protect public order or the honour and the reputation of the President and, therefore, there had been a violation of article 19.
ثم إن شدة العقوبات المفروضة على صاحب البلاغ لا يمكن عدها تدبيرا متناسباً لحماية النظام العام أو لصيانة شرف الرئيس وسمعته وبالتالي وقع انتهاك لأحكام المادة 19.

4.6 As to the case under consideration, the penalty imposed on the author is not the consequence of any infringement of traffic regulations, but is the consequence of the offence committed by the owner of the vehicle visàvis the duty to cooperate required by law of any vehicle owner.
4-6 أما في الحالة قيد النظر، فإن العقوبة المفروضة على صاحب البلاغ لم تأت نتيجة لأي مخالفة لقانون المرور وإنما نتيجة لإخلال مالك السيارة بواجب التعاون الذي ينص عليه القانون بالنسبة لمالك أي سيارة.

7.10 In light of the above, the Committee considers that, in the present case the sanction of imprisonment imposed on the author was incompatible with article 19, paragraph 3, of the Covenant.
7-10 وبناءً على ما تقدم، ترى اللجنة أن عقوبة السجن المفروضة على صاحب البلاغ في هذه القضية تتعارض والفقرة 3 من المادة 19 من العهد.

2.8 On 29 May 2009, the Asylum Sector of the Ministry of Security extended for a period of 90 days, as of 4 June 2009, the measures imposed on the author with regard to restriction of movement and the prohibition on leaving the facilities of the immigration centre in Sarajevo.
2-8 وفي 29 أيار/مايو 2009، مدّد قسم اللجوء في وزارة الأمن التدابير المفروضة على صاحب البلاغ بشأن تقييد حركته ومنعه من مغادرة مرافق مركز الهجرة في سراييفو لمدة 90 يوماً اعتباراً من 4 حزيران/يونيه 2009.

6. In this case, the Committee concludes that the sanction imposed on the author is incompatible with article 19, paragraph 3, of the Covenant (para. 7.10) and consequently decides that the facts disclose a violation of this article (para. 8).
6- وفي هذه القضية، تخلص اللجنة إلى أن العقوبة المفروضة على صاحب البلاغ تتعارض مع الفقرة 3 من المادة 19 من العهد (الفقرة 7-10) وتستنتج من ثم أن الوقائع تكشف عن حدوث انتهاك لهذه المادة (الفقرة 8).

9.5 As to the " purpose and character " of the sanctions, the Committee notes that, although administrative according to the State party's law, the sanctions imposed on the author had the aim of repressing, through penalties, offences alleged against him and of serving as a deterrent for others.
9-5 وفيما يتعلق ب " غرض وطابع " الجزاءات، تلاحظ اللجنة أنه بالرغم من أنها جزاءات إدارية وفقاً لقانون الدولة الطرف، فإن الجزاءات المفروضة على صاحب البلاغ تهدف، من خلال العقوبات المفروضة، إلى قمع الجرائم المنسوبة إليه وردع غيره.

As to the conditions of " purpose and character " of the sanctions, the Committee notes that, although administrative according to the State party's law, the sanctions imposed on the author had the aims of repressing, through penalties, offences alleged against him and of serving as a deterrent for the others, the objectives analogous to the general goal of the criminal law.
أما فيما يتعلق بشروط الجزاءات من حيث " غرضها وطابعها " ، تلاحظ اللجنة أنه بالرغم من أنها جزاءات إدارية وفقا لقانون الدولة الطرف، فإن الجزاءات المفروضة على صاحب البلاغ تهدف إلى قمع الجرائم المنسوبة إليه وإلى ردع الآخرين، من خلال توقيع جزاءات، وهي أهداف تشبه الهدف العام للقانون الجنائي.

The Committee concluded that, in the absence of any pertinent explanations from the State party, the restrictions on the exercise of the author's right to freedom of expression could not be deemed necessary for the protection of national security or of public order (ordre public) or for respect for the rights or reputations of others.
وخلصت اللجنة، في غياب أي تفسيرات وجيهة من الدولة الطرف، إلى أن القيود المفروضة على صاحب البلاغ في ممارسة حقه في حرية الرأي لا يمكن اعتبارها لازمة لحماية الأمن القومي أو النظام العام أو لاحترام حقوق الآخرين أو سمعتهم.
