Confidentiality in challenge proceedings No information shall be disclosed in challenge proceedings and no public hearing under articles 66 and 67 of this Law shall take place if so doing would impair the protection of essential security interests of the State, would be contrary to law, would impede law enforcement, would prejudice the legitimate commercial interests of the suppliers or contractors or would impede fair competition.

(5) Subject to articles 8 (1), 34 (4) (d) and 39 (2), the procuring entity shall establish no criterion, requirement or procedure with respect to the qualifications of suppliers or contractors that discriminates against or among suppliers or contractors or against categories thereof on the basis of nationality, or that is not objectively justifiable.

49 - تُعد سندات العطاءات وسندات ضمان حسن الأداء، كما يرد في الفقرة 48 من التقرير (A/64/284)، صكوك ضمان مصممة لحماية المنظمة من مخاطر عدم وفاء المقاولين أو البائعين المتعاملين معها بالتزاماتهم.

6. Other than any criterion, requirement or procedure that may be imposed by the procuring entity in accordance with article 8 of this Law, the procuring entity shall establish no criterion, requirement or procedure with respect to the qualifications of suppliers or contractors that discriminates against or among suppliers or contractors or against categories thereof, or that is not objectively justifiable.
6- ما عدا أيَّ معيار أو اشتراط أو إجراء قد تفرضه الجهةُ المشترية وفقاً للمادة 8 من هذا القانون، لا تفرض الجهةُ المشترية بشأن مؤهّلات الموَرِّدين أو المقاولين أيَّ معيار أو اشتراط أو إجراء يُمثِّل تمييزاً تجاه الموَرِّدين أو المقاولين أو فيما بينهم أو تجاه فئات منهم، أو لا يمكن تسويغه موضوعيا.

10. The provisions of the article on disclosure of information to suppliers or contractors or the public are subject to article 23 on confidentiality (which contains limited exceptions to public disclosure).
