(a) The procuring entity shall issue a written invitation to present submissions simultaneously to each supplier or contractor party to the framework agreement, or only to each of those parties of the framework agreement then capable of meeting the needs of that procuring entity in the subject matter of the procurement;

The rules and procedures are designed to ensure effective competition at the second stage: for example, all suppliers or contractors parties to the framework agreement are, in principle, entitled to participate at the second stage, as is explained further in the commentary to article 61 below.

7. The provisions of subparagraph (a) require all suppliers or contractors parties to the framework agreement to be invited to participate or, where relevant, only those " capable " of fulfilling the procuring entity's requirements.
7- وتقضي أحكام الفقرة الفرعية (أ) بدعوة جميع المورّدين أو المقاولين الأطراف في الاتفاق الإطاري إلى المشاركة أو بالاكتفاء، عند الانطباق، بدعوة من كان منهم " قادرا " على الوفاء بمتطلبات الجهة المشترية.

3. In the context of a multi-supplier closed framework agreement, the procurement regulations must guide the procuring entity on whether setting either a minimum or a maximum number of suppliers or contractors parties to a framework agreement or both would be appropriate and, if so, what to consider in doing so.
3- وفي سياق الاتفاق الإطاري المغلق المتعدد المورِّدين، يجب على لوائح الاشتراء أن ترشد الجهة المشترية بشأن ما إذا كان من المناسب تحديد عدد أدنى أو أقصى من المورِّدين أو المقاولين الأطراف في الاتفاق الإطاري أو كليهما، وفي هذه الحالة ما ينبغي النظر فيه تحقيقا لذلك.

(d) A maximum number of suppliers or contractors parties to the framework agreement, if any, and the procedure and criteria for the selection of that maximum.

(c) An " open " framework agreement procedure, involving a framework agreement concluded with more than one supplier or contractor and involving second-stage competition between suppliers or contractors parties to the agreement.

The responsive submissions are then evaluated, applying the evaluation criteria disclosed in the solicitation documents, and subject to any applicable minimum or maximum number of suppliers or contractors parties as set in the solicitation documents.

5. The procurement regulations must guide the procuring entity as regards the need in some cases to conclude separate agreements with individual suppliers or contractors that are parties to the framework agreement.
5- ويجب على لوائح الاشتراء أن توجه الجهة المشترية بشأن الحاجة في بعض الحالات لإبرام اتفاقات منفصلة مع فرادى المورِّدين أو المقاولين الأطراف في الاتفاق الإطاري.

(f) If the procuring entity intends to enter into a framework agreement with more than one supplier or contractor, a statement that the suppliers or contractors that are parties to the framework agreement will be ranked according to the selection criteria specified;
(و) بياناً بأن المورّدين أو المقاولين الأطراف في الاتفاق الإطاري سيرتَّبون وفقا لمعايير الاختيار المحددة، إذا كانت الجهة المشترية تعتزم إبرام اتفاق إطاري مع أكثر من مورّد أو مقاول واحد؛

To that end, the procuring entity should be permitted to identify in advance those suppliers or contractors party to the framework agreement which it considered to be capable of meeting its needs and to issue the written invitation to present submissions only to them.

Mr. Grand d'Esnon (France) said that the simplest solution would be to use only the first part of subparagraph (4)(a) as originally drafted: " The procuring entity shall issue a written invitation to present submissions simultaneously to each supplier or contractor party to the framework agreement; " .
27- السيد غران ديسنون (فرنسا): قال إنَّ الحل الأسهل يكمن في الاكتفاء باستخدام الجزء الأول من الفقرة الفرعية (4) (أ) كما صيغ في البداية، أي: " تُصدر الجهة المشترية دعوة كتابية إلى تقديم العروض تُوجّه في وقت واحد إلى كل واحد من المورِّدين أو المقاولين الأطراف في الاتفاق الإطاري؛ " .
