In response to an enquiry as to whether the procuring entity should provide justifications for a decision to reject all submissions, the general view was expressed that the procuring entity should not be required to provide any justification, but should inform the suppliers or contractors concerned of the decision and grounds for it.
114- وردّا على استفسار بشأن ما إذا كان ينبغي أن تبرّر الجهة المشترية قرارها رفض جميع العروض، ساد الرأي القائل بأنه لا ينبغي أن تلزم الجهة المشترية بتقديم أي تبرير، لكن عليها أن تبلغ المورّدين أو المقاولين المعنيين بالقرار وبالأسباب الداعية إليه.

A preference was expressed for reinstating the following words at the end of the proposed subparagraph (c): " and shall run from the date of the dispatch of the notice to all the suppliers or contractors concerned in accordance with this paragraph. "
227- وأُبدي تفضيل لإعادة إدراج الصيغة التالية في نهاية الفقرة الفرعية المقترحة (ج): " وأن تسري ابتداء من تاريخ إرسال الإشعار إلى جميع المورّدين أو المقاولين المعنيين وفقا لهذه الفقرة. "

A consensus emerged to reinsert the following words at the end of the proposed subparagraph (c): " and shall run from the date of the dispatch of the notice to all the suppliers or contractors concerned in accordance with this paragraph. "
230- وتوافقت الآراء على إعادة إدراج الصيغة التالية في نهاية الفقرة الفرعية المقترحة (ج): " وأن تسري ابتداء من تاريخ إرسال الإشعار إلى جميع المورّدين أو المقاولين المعنيين وفقا لهذه الفقرة. "

In order to make this provision effective, the procuring entity must permit prompt access by the suppliers or contractors concerned to the relevant parts of the record. Delaying disclosure until, for example, the entry into force of the procurement contract might deprive aggrieved suppliers and contractors of a meaningful remedy.
ومن أجل جعل هذا الحكم نافذاً يجب أن تسمح الجهة المشترية فوراً للموردين أو المقاولين المعنيين بالاطلاع على أجزاء السجل ذات الصلة.() فتأجيل إطلاعهم عليها لحين بدء نفاذ عقد الاشتراء، مثلاً، قد يحرم المورِّدين والمقاولين المتضررين من وسيلة انتصاف مهمة.

16. As regards paragraph (2), it was agreed that the reference in the paragraph to article 12 (3) should be deleted, so that notice of the rejection of all tenders, proposals, offers or quotations would have to be communicated to all suppliers or contractors concerned in a form specified in paragraph (1).
16- وبشأن الفقرة (2)، اتُفق على أن الإشارة في تلك الفقرة إلى الفقرة (3) من المادة 12 ينبغي أن تُحذف، بحيث أن الإشعار برفض جميع العطاءات أو الاقتراحات أو العروض أو عروض الأسعار سيتعيّن أن يوجّه إلى جميع المورّدين أو المقاولين المعنيين في شكل محدّد في الفقرة (1).

In order to remove a perceived ambiguity in the provisions as regards the reference to " suppliers or contractors concerned " , the suggestion was made to refer consistently in subparagraph (c) either to " suppliers or contractors that did not win " or to " suppliers or contractors whose submissions were evaluated " .
241- وتبديداً لما يُتصوَّر وجوده في هذه الأحكام من غموض فيما يخصّ الإشارة إلى " المورّدين أو المقاولين المعنيين " ، اقتُرح أن يشار على الدوام في الفقرة الفرعية (ج) إلى " المورّدين أو المقاولين الذين لم يفوزوا أو إلى " المورّدين أو المقاولين الذين قُيِّمت عروضهم " .

(c) The period before the entry into force of the procurement contract during which the suppliers or contractors concerned may seek review of the decisions of the procuring entity related to the ascertainment of the successful tender or submission (the standstill period shall be [...] (to be determined by an enacting State)). "
(ج) الفترة التي تسبق بدء نفاذ عقد الاشتراء والتي يجوز للمورّدين أو المقاولين المعنيين أن يطلبوا أثناءها إعادة النظر في قرارات الجهة المشترية بشأن تأكيد العطاء أو العرض الفائز (وتكون فترة التوقُّف [...] (تحددها الدولة المشترعة)). "
