٩٦- وفي البلدان الصناعية ينظم بيع المنتجات السمية في اﻷسواق الداخلية بموجب قوانين صارمة بينما لا توجد تشريعات بشأن التصدير، وإن وجدت فهي متسامحة للغاية.

32. The realization of the right to health in the context of armed conflict and toxic and dangerous products requires States to take all appropriate measures to limit human exposure to toxic products released during an armed conflict.
32- وإعمال الحق في الصحة في سياق النزاعات المسلحة وإطلاق المنتجات السمية والخطرة يتطلب من الدول اتخاذ جميع التدابير الملائمة التي تحد من تعرض البشر للمنتجات السمية التي تطلَق أثناء نزاع مسلح.

37. Access to information and communication of information about the effects and exact nature of toxic products released into the environment is essential to guarantee certain other rights, such as the right to life, to health and to adequate food.
37- الحق في تلقي ونشر المعلومات المتعلقة بالأضرار التي تحدثها المنتجات السمية المطْلَقة في البيئة أمر لا غنى عنه لضمان بعض الحقوق الأخرى كالحق في الحياة والحق في الصحة والحق في الغذاء الكافي.

An attack which could cause the release of toxic and dangerous products would violate this principle if the toxic products released could be expected to cause deaths or health problems in the civilian population or damage to civilian objects, including the natural environment, which would be excessive in relation to the military advantage gained from the destruction of the facility.
فأي هجوم قد يتسبب في إطلاق منتجات سمية وخطيرة ينتهك هذا المبدأ إذا كان يُتوقع من المنتجات السمية المطلقة التسبب في وفيات أو في مشاكل صحية للسكان المدنيين أو في إلحاق أضرار بالأعيان المدنية بما فيها البيئة الطبيعية، تكون مفرطة بالمقارنة مع الميزة العسكرية التي تتحقق من تدمير المنشأة.

61. In addition to calling for a response to the release of toxic products during armed conflict which integrates a human rights approach, the Special Rapporteur would like to make the following recommendations:
61- وإضافة إلى الدعوة إلى الرد على إطلاق المنتجات السمية أثناء النزاعات المسلحة رداً يعتمد نهجاً قائماً على حقوق الإنسان، يود المقرر الخاص أن يقدم التوصيات التالية:

Cooperate to prevent the introduction into the zone of wastes and other matters, such as toxic, harmful or noxious substances, industrial waste or sewage sludge, in particular for their disposal at sea and adopt preventive forms of activity that include contingency procedures in case of accidents and liability for the discharge of toxic products at sea;
٦ - التعاون من أجل منع تعرض المنطقة لدخول النفايات وغيرها من المواد، من قبيل المواد السمية أو الضارة، أو النفايات الصناعية، أو حمأة المجارير، ولا سيما بالنسبة لالقائها في البحر، واﻷخذ بأشكال وقائية من النشاط تشمل إجراءات للطوارئ في حالة وقوع حوادث والمسؤولية عن تصريف المنتجات السمية في البحر؛

12. While the Special Rapporteur has not yet reached any final general conclusions regarding her mandate, she is already sure that women and children are not spared the adverse effects of the illicit movement of toxic products and dangerous waste, even though they remain to a certain extent less exposed than men.
12- ولئن لم تخلص المقررة الخاصة بعد إلى استنتاجات عامة نهائية فيما يتصل بولايتها، فبإمكانها أن تؤكد فعلاً أن النساء والأطفال ليسوا في منأى عن الآثار الضارة للإتجار غير المشروع في المنتجات السمية والنفايات الخطرة، وإن كانوا إلى حد ما أقل تعرضاً لها من الرجال.

2. In her preliminary report (E/CN.4/1996/17), the Special Rapporteur gave an overview of questions related to the illicit dumping of toxic products and analysed the legal framework and international standards relevant to the exercise of her mandate.
